Full context would help here. Is the bank stating that it will undertake to do something only if it is understood beforehand that the usual rule of confidentiality will not apply? This might explain the passive voice.

La pregunta original era sobre el infinitivo (relevar). EMHO, la traducción de la frase iría entonces en pasiva:

Se hace constar que se le releva expresamente del deber de secreto bancario establecido por ley, en virtud de tratarse de indagatoria penal en trámite.
You are hereby relieved of the statutory obligation to keep banking information as confidencial, by virtue of the fact that there is an ongoing criminal investigation.
