En relación al ámbito penal, y de acuerdo con la diferencia existente en el Código penal español entre ‘sustancias que causen grave daño a la salud’ y los demás casos, el Tribunal Supremo ha venido considerando, al menos desde 2014, que la hoja de coca es una sustancia que no causa grave daño a la salud, lo que permite la aplicación del subtipo penal atenuado, y las penas contempladas se ven notablemente reducidas respecto al tipo genérico.
