From a Cuban court judgement:
"La petición del Fiscal consiste en que al acusado se le imponga como pena la de 5 años de privación de libertad subsidiados por igual periodo de trabajo correccional con internamiento."
Should "subsidiado" in this context simply be "substituted", or is there another term for it that I'm overlooking?

I would add this at the end of your sentence. I understand that Cuban courts have the authority to sentence defendants to less severe punishments under certain circumstances.
From the Cuban "Código Penal":
ARTÍCULO 32.1. La sanción de trabajo correccional con internamiento es subsidiaria de la de privación de libertad que no exceda de tres años y es aplicable cuando, por la índole del delito y sus circunstancias y por las características individuales del sancionado, existen razones fundadas para estimar que su reeducación es susceptible de obtenerse por medio del trabajo.

: The meaning is there, but I think it lacks the right amount of register if you actually go ahead and translate the whole phrase.

I think the other posters have done the hard work, but I am not sure "substituted" would match the register very well. And "subsidiary sentence" does not sound appropriate. I think you could say, "the prosecutor (the prosecution) is requesting the defendant be sentenced to 5 years imprisonment, or alternatively an equivalent period of prison labor."
