"El artículo 36.3 de la Ley Orgánica 14/2003, de 20 de noviembre, sobre derechos y libertades de los extranjeros en España y su integración social, declara la responsabilidad en orden a las prestaciones de los empresarios que tengan a su servicio trabajadores extranjeros en situación irregular, sin que la carencia de la autorización administrativa para trabajar de éstos pueda impedir su acceso a las prestaciones de seguridad social que pudieran corresponderles. De acuerdo con este precepto, un buen número de Tribunales Superiores de Justicia reconocieron el derecho a la percepción de la prestación por desempleo de trabajadores inmigrantes en situación irregular y sin autorización administrativa para trabajar. La sentencia del Tribunal Supremo, en unificación de doctrina, de 18 de marzo de 2008, interpreta restrictivamente dicho artículo 36.3 de la Ley de Extranjería, negando el derecho de los inmigrantes en situación irregular a percibir prestaciones por desempleo."
