El caso penal entonces, resulta ser un conflicto entre el Estado y el imputado, es decir, el Estado estalece los delitos, imputa los mismos, y dirige su acción contra el delincuente. El interés prevaleciente de este modo de practicar lo jurídico es la persecución y no la resolución del conflicto.

Derivado de lo anterior, en el Derecho persisten notables debates entre _penalistas inquisidores_ o persecutorios y garantistas o abolicionistas, pues desde los principios garantistas todo el poder del Estado se dirige contra ese individuo acusado.

Elizabeth, I think the text is talking about different paradigms for the criminal justice system. From persecution and retribution, through systems that guarantee the rights of the individual, to abolitionism.
