Spanish term

permuta

Spanish to English Law/Patents Law: Contract(s) Purchase policy
Hola,

Discussion

Manuel Aburto (asker) Aug 31, 2020:
I agree with Robert,
"Buy and sell agreement" does not convey the meaning of the Spanish version of the text.
Robert Carter Aug 30, 2020:
@Francois Look at the context given here. How could it possibly mean "buy and sell agreement"? The text is talking about making changes to the substance of a contract, and of "obras a permutar". By your logic, would that then mean "works to be bought and sold"? I'm actually baffled as to how anyone with practical knowledge of Spanish and English could even come up with a translation like that. I'm genuinely interested to find out because it's not like it's even close to what the Spanish is trying to say.
Furthermore, if they had in fact meant to say "buy and sell agreement," why wouldn't they simply use the standard ubiquitous Spanish term for that, i.e., "contrato de compraventa"?
Manuel Aburto (asker) Aug 29, 2020:
Thanks again Robert for the recommendation!
Robert Carter Aug 29, 2020:
I agree with you, Manuel, permuta has been misused here. It definitely doesn't mean "barter." I think even "swap" would be appropriate here.
Manuel Aburto (asker) Aug 28, 2020:
Hola Emiliano y Sergio,

Manuel Aburto (asker) Aug 28, 2020:

I don't think "barter" is appropriate in the context, but I don't feel so strongly about it that I'd take up cudgels.

Based on the definitions and sample sentences mentioned in the discussion, it appears simply to refer to changes in the project/contract. This could involve exchanges of materials and/or responsibilities, or indeed any changes or deviations in general from the initial plan.

These " exchanges of materials and/or responsibilities" could be referred to as "bartering/trueque" in an informal register, in conversations between the companies or agents involved, but I wouldn't use it in this formal description of the modifications.
Peer comment(s):

agree Luis M. Sosa : Agree. It is change, i.e. they are about to sign a change order to the lump sum contract.

Yet still surpisingly valid, despite your nitpicking :-)
agree Robert Carter : Yes, precisely, I'd imagine it's swapping out one part of the contract for another item of the same value.

agree David Hollywood : maybe modify/modifications

buy and sell agreement

Permuta

Peer comment(s):

disagree Robert Carter : You've mistaken a non-technical term for a technical one here, and to top it all, you've provided a mistranslation of "permuta"! Saludos!//That makes no sense at all.

Spanish term (edited): permuta de obras vs. cambio de contrato

work change order vs. contract modification

& civil engineering works vs. cambios de contrato: contract alterations.

I think the distinction here is between the contract modifications and the swap-over of material. Compare 'revamping', 'repurposing', 're-assignning'and 'recycling'.
Example sentence:

We revamp facilities or equipment in all of our customers industries range, refurbishing materials handling equipment, from conveyors to stockyard machinery, loading/unloading equipment, lifting equipment, bridge and gantry cranes, and waste treatment sys

A change order is work that is added to or deleted from the original *scope of work of a contract*
