O melhor seria você dar a frase inteira.
Se a tradução tradicional em inglês é failed, não discuto, mas só gostaria de observar que rato em português significa confirmado, reconhecido, do latim ratus, de idêntico significado, como se pode ver neste dicionário: http://www.priberam.pt/dlpo/default.aspx?pal=rato Portanto, rato em português como adjetivo não tem nada que ver com falido.

Formal but unconsummated marriage

"Rato" is something that is legally signed or fully recognized by a social group or a culture _ as it has been very well remarked above by Luciano.
I would change the "e" into "mas" because formally married people facing such situation usually ask their marriage to be annulated. The word "rato" makes all the sense once it does not refer to a common law marriage which status is recognized by legislation in many US states.
