Well, I guess this one isn't that diffacult ... Translators covering real estate as a core field should be able to answer this one in a minute -- I guess?

Baurecht includes both planning consent and building regulation compliance. It also includes Nachbarecht as part of privates Baurecht. From my experience in Germany it is part of the architect's responsibility to ensure that the development does not infringe the neighbour's rights (of access, light support etc). From the context of the source text it would appear the firm in question is emphasising a legally watertight development. So I would suggest a more general phrase such as "legally compliant development"

Ist das nicht eigentlich ... ... ein Unding -- Baurecht kann doch auf dieser Ebene kaum geschaffen werden, höchstens kann man Grundstückstitel erwerben und Baugenehmigungen erwirken (obtaining building permits/rights). Letzteres ist evtl. gemeint. Dagegen würde ich die "Erschließung" eben als "development" übersetzen.

Aber ok, ich übersetze nur gelegentlich auf diesem Gebiet.

Compliance with building legislation

I'm very much inclined to agree with Olaf, that it's not easy to 'create' Baurecht, but I take it they really mean developing a scenario where all aspects of 'Baurecht' as defined below are complied with. I'd say obtaining planning permission is only a very minor part of it.
