Verfügungsgrund ... entfallen

German to English Law/Patents Law (general) dispute about labeling of medicinal device
I am working on a document describing a dispute between two manufacturers of a similar medical device. In this document, the following sentence occurs: "Die Antragsgegnerin meint, der Verfügungsgrund sei durch zögerliches Vorgehen der Antragstellerin entfallen." I was asked to translate the document because of the medical content, but I am having trouble with this particular sentence - would appreciate any help.

are we really talking about an injunction here? i.e. court order to immediately do or not do something?

agree Dr. Fred Thomson : Can also be grounds for the injunction; The Verfuegung could be a court order of a different kind. The context must tell the tale.
