Art. 5 I 1 GG **ist verkannt**, wenn Formulierungen, in denen die Bewertung tatsächlicher Vorgänge zum Ausdruck kommt, als Tatsachenbehauptungen angesehen werden.

This refers to Article 5 of the Grundgesetz, the German constitution, more specifically to the first sentence in the first subsection saying:
"Jeder hat das Recht, seine Meinung in Wort, Schrift und Bild frei zu äußern und zu verbreiten und sich aus allgemein zugänglichen Quellen ungehindert zu unterrichten."

I'd say that "misconstrued" or "misinterpreted" would fit here. Perhaps use nominal style:
"It is a misconstruction/misinterpretation of Art. 5 I 1 GG if..."
