fulfill, perform, execute etc. No, I think it's a question of nuance and personal preference and not easily summarised. In this case, though, I'd say "the execution of the contract or parts thereof which are still outstanding" and I'd also go with "is of no FURTHER interest to him". Also - if I may say - "proven" used in this way is a bit US specific - fine if it's for a US audience. Otherwise "proved". "Proven" in what I call "proper English" is an adjective "a proven fact".
Back to fulfill, perform, execute - fulfill definitely has the sense of meeting obligations or duties. Execute has more the sense of carrying out something that has already been specified. Perform, to me, is a rather more recent term in this sense and has some suggestion of the quality of execution. But they are very interchangeable. I'm quite interested in these posts from Martina as I am currently translating VOB Teil A & B 2009 and I find it amazing that a) I haven't already translated it and b) that translations into English seem not to be available. So I too have been tussling with phrases of this kind...

... after having proven that, due to the delay, the performance of the duties/obligations under this contract which are either totally or partially unfulfilled is of no interest to him.
Oder
... after having proven that, due to the delay, he is no longer interested in the fulfilling/performance of this contract which has not yet been executed, either totally or partially.
Sicher etwas umständlich und verbesserungswürdig.
Für erfüllen/Erfüllung kenne ich "fulfill", "perform/performance" und "execute/execution". Weiß jemand, ob es bei den englischen Begriffen Bedeutungsunterschiede gibt?
