Discussion

USER00230 (X) (asker) Nov 21, 2005:
Exactly. But i was puzzled because it seems silly. Where might the German Investment Act be applicable, I wonder? Hmmm...let me see. Germany? Actually, I suspect it doesn't have a strictly territorial meaning here, I think it's probably a deliberately vague "Floskel".
Michael Rose Nov 21, 2005:
The meaning is that they don't have to determine a fund price on public holidays. Public holidays where the investment act is applicable.
USER00230 (X) (asker) Nov 21, 2005:
thanks for the answers, but can anyone conjecture why (the hell) the public holidays are "im Geltungsbereich des Investmentgesetzes"? Beats me.

scope of application

...as in: "...falling within the law's scope of application..." or so. ;-)

Romain (4th Ed.) suggests "extent of validity, scope/area of application, sphere of operation, purview, area of application."

One of the glossaries here on ProZ has "scope," which may also work here. :-)

AFTER ADDED NOTE: I understand it to mean the area, to which the Investment Act applies.

So, let's assume that this act does not apply to the United States of America. I would understand this to mean that the American holidays would not be taken into account.

ut if the act were, for example, to apply to all of Europe (and not just Germany, or a part of it), all European holidays, i.e. those of the several states would be taken into account.

If, however, the act were only to apply to Schleswig-Holstein, then the catholic holidays of the South wouldn't be taken into account.

And so on... at least that is how I understand it in this particular context (note my low confidence level). ;-)

I've got a link to the law, but after shortly going through it, I wasn't able to find an express section defining what the "Geltungsbereich" is, but it is mentioned several times (see: http://www.bafin.de/gesetze/invg.htm#p1 ).

Hi Bill, Take a look at the "Basisdaten" in the upper right corner here: http://de.wikipedia.org/wiki/Investmentgesetz_(Deutschland)

It says there "Geltungsbereich: Deutschland"... :-)

Maybe it has something to do with the possibility that territories (and names) can change. This way, no matter how large the territory is or what it is called, the act will apply to it. Does that make sense? I'm thinking "unification" here, but I may be way off-track (it is getting a bit late - and I was up way early this morning). ;-)
Note from asker:
thanks, but how does a public holiday fall within the scope of application of the law?
tks for further answers - I suspect you're right but it seems rather odd since a German law obviously applies to Germany (where else would it apply to?!) I guess it's just sloppy drafting and in the end it's basically a "Floskel" and like many Floskeln it sounds pompous and indeed meaningless when translated into English.

Thank you msherms. :-)

Yes, that would also work (IMHO - at least that is how I understand it). Thanks Kim. :-)

disagree Kim Metzger : Both suggestions are way off target, as usual. See below.

territory of application

on public holidays in the territory of application of the investment law...

this is another suggestion; perhaps territory fits better since they're referring to a geographic area
