French term

lié par les faits repris

Appeal proceedings.

thanks

writeaway Mar 27, 2016:
imo, bound by makes the most sense.
Julie Barber (asker) Mar 27, 2016:
Afternoon and Happy Easter! Hope you are keeping well. My question is also lié par; I wasn't sure if here it means that the judge deals with facts processed by the lower judges or is "bound" by these fact (saw it in a dictionary and wasn't sure...) thanks
writeaway Mar 27, 2016:
repris par les juges du fond. You have to look at repris par. That should clear up any confusion.

bound by the matters of fact adopted or accepted

as opposed to matters of law > en droit.

Reprendre does not mean reiterate in this context whereas, in a defence drafted in E&W law, the claimant's points of claim may be 'deemed repeated' to avoid writing them out in full.

boils down to: bound by the trial judges' findings of fact

Not any more...
neutral Andrew Bramhall : You can't "adopt'"matters of fact; they are facts or they aren't facts, they're accepted as fact, or rejected as such;

Not so, plus I have added 'accepted' to cover that predictable objection. www.llrx.com/features/turingtest.htm where there are at least 10 instances of the court's adoption of findings of fact.
