Hi all. I'd really appreciate some input on this :

"Dans le cas où l’entité adjudicatrice renonce à affermir la tranche optionnelle, le Titulaire ne pourra pas prétendre au versement d’une ****indemnité de dédit ou d’attente****."

Could it be something like "retraction or stand-by penalty" ?

FHS Bridge's FR/EN glossary:

1. dédit >renunciation; repudiation; promisor's right not to perform his obligation (query: repudiatory breach).

2. indemnité d’attente: demurrage, but incongruous here, unless the tender is for shipping or port loading services etc.

Expectation loss vs. reliance loss: too elaborate to explain (meaning I've never really understood the difference).


Example sentence:

The aim of expectation loss damages is to put the innocent party in the same position as if the contract had been performed.

agree Nikki Scott-Despaigne : Repudiation spring to my mind too. "Demurrage" automatically makes me think of shipping, but a couple of years in P and I work is probably to blame. And yes for "expect° loss", explained anyway in the Thomson Reuter source you cite.

Thanks. Problem is repudiation routinely doubles up with a repudiatory breach - and the withdrawal from the offer may not be a breach.
