Investment arbitration case between German company and State of libya.
“… afin que le Tribunal puisse examiner les modalités de réglement par le Demandeur de la part de la provision sur les frais d’arbitrage impayée en raison de la défaillance du Défendeur.”
I find this sentence a bit convoluted and the links/prepositions are confusing me. i.e. the use of "par" in the context of the other phrases. Is this saying that the "terms of the settlement BY the Claimant, IN SO FAR AS PAYING THE ARBITRATION COSTS in the case of Defendant's breach." ? I think I have mixed something up here.

The sentence is clearer if rewritten this way:
"… afin que le Tribunal puisse examiner les modalités de réglement -par le Demandeur- de la part de la provision sur les frais d’arbitrage impayée en raison de la défaillance du Défendeur.”

Something of that sort allows you to convey the meaning with accuracy, without missing out anything of the meaning, yet avoiding the repetition. The trick is to think of how to replace "Défendeur" and things fall into palce. There are other ways of phrasing this of course. My suggestion is one among many possibilities.
règlement des frais = payment of costs
...so that the Court may examine the terms of payment by the Claimant of that part of the provision towards arbitration costs which has remained unpaid due to the Defendant's failure to pay.
