Mình đang dịch một bộ luật của Mỹ gọi là Uniform Trust Code (tạm dịch: Bộ Luật Tín Thác Thống Nhất) thì gặp từ này trong đoạn sau:
"This article deals with representation of beneficiaries, both representation by fiduciaries (personal representatives, trustees, guardians, and conservators), and what is known as virtual representation. Representation is a topic not adequately addressed under the trust law of most States. Mình tra cứu thì hiểu từ này miêu tả trường hợp mà một bản án có thể ràng buộc một người không phải là một bên tham gia tranh tụng nếu một trong các bên tham gia tranh tụng có mối liên kết chặt chẽ với lợi ích của bên không liên quan đến mức người không liên quan đã được đại diện bởi bên đó tại tòa. Ví dụ, một bản án chỉ đề cập đến người chồng cũng có thể ràng buộc vợ của anh ấy.

Đầu tiên cần biết representation là gì. Representation trong ngữ cảnh pháp luật đặc biệt ở chỗ người đại diện trước tòa có nhiệm vụ rất cụ thể đó là trình bày tình tiết cho thân chủ và biện hộ nếu cần thiết. Đối với người lớn, chỉ có 2 loại representation:
Legal representation: đại diện pháp luật, tức luật sư, là người bị ràng buộc pháp lý phải đại diện cho thân chủ
Self represenation: thân chủ tự đại diện cho mình
Ở cả 2 trường hợp này, có thể thấy là thân chủ có quyền định đoạt ai sẽ đại diện cho mình và đó là điều rất quan trọng trước tòa án.
