unspent/spent offences hay unspent/spent conviction được gọi là Án đã mãn hay án chưa mãn.

Với người có spent conviction sẽ không phải khai báo về việc có án khi kê khai thông tin. Với người có unspent conviction, sẽ phải khai báo về tình trạng có án trong lý lịch khi kê khai thông tin cá nhân.

"An 'unspent' conviction is one that a person must admit to when asked to disclose their criminal history. Convictions that have become 'spent' need not be revealed. This is to help people who have been convicted of less serious criminal offences and have since lived on the right side of the law. What would count as an 'unspent' conviction?

If you have ever been convicted of an offence for which a sentence of more than 2½ years was imposed (regardless of the amount of time you actually spent in prison) this conviction can never become 'spent': it's an 'unspent' conviction which you must disclose when asked about your criminal convictions (such as when applying for a licence or a job).


Is this the only time a conviction is 'unspent'?

No. If you were given a sentence of 2½ years or less, your conviction may be ‘unspent’. Whether or not depends on the length of time that's elapsed since the date of your conviction. This time is called the 'rehabilitation period' - and it differs according to the type of sentence passed.


So, what's the rehabilitation period for my sentence?

The following table shows a range of rehabilitation periods for different sentences imposed. Your conviction will remain 'unspent' until the period shown has elapsed and you must declare it."

Tiền án, tiền sự là gì?

“Thế nào là tiền án, thế nào là tiền sự, thời hạn để xóa tiền án, tiền sự?" (bạn đọc Trần Trọng Tuấn).

Trả lời:

1. Người có tiền án (án tích) là người đã bị kết án và thi hành hình phạt mà chưa được xóa án. Người được xóa án tích thì coi như chưa bị kết án.

Bộ luật Hình sự quy định nhiều hình thức xóa án tích: đương nhiên được xóa án tích (ví dụ, người nào bị tòa án tuyên phạt tù đến 3 năm, đã chấp hành xong hình phạt và 3 năm sau không phạm tội mới, thì đương nhiên được xóa án tích); xóa án tích theo quyết định của tòa án (áp dụng với các tội xâm phạm an ninh quốc gia, tội ác chiến tranh); xóa án tích trong trường hợp đặc biệt (ví dụ: người đã thi hành xong hình phạt tiến bộ rõ rệt, được chính quyền địa phương nơi cư trú đề nghị tòa xóa án tích)
