English to Russian Science Patents
Specifically, the Examiner points out that if the deposit is made under the Budapest Treaty, a statement, affidavit or declaration by Applicant, or by an attorney of record, or by someone in a position to corroborate the facts of the deposit, that the instant invention will be irrevocably and without restriction released to the public upon the issuance of a patent, is required to satisfy the deposit requirement, (see OA, pages 3-5).

The Examiner rejects claims 1 and 25 under 35 U.S.C. 101 because the claimed invention is directed to a judicial exception without significantly more.

Judicial exception — те вещи, которые нельзя признать подлежащим патентованию изобретением. В западном юридическом пространстве это законы природы, природные явления и абстрактные идеи.
Significantly more — основывающиеся на использовании этих вещей изобретения, которые МОЖНО запатентовать.

Иначе говоря, нельзя запатентовать северное сияние, но можно запатентовать способ получения из него энергии.
