A person can ***submit*** by the following ways:
by Merits: Arguing first and exclusively the case on its merits by filing a statement of defense. BUT See R. 27: other words, a person has the ability to assert that the AB courts have no jurisdiction without submitting to that jurisdiction (ie: Kroetsch)
***By contract***: If the D is outside of AB, the D must be served ex juris, see R 30 (f).

"jurisdiction by submission" se referă la determinarea competenţei teritoriale a instanţei de judecată, şi se poate realiza pe două căi:
- acordul pârâtului (submission to the jurisdiction)
- acordul părţilor (submission by agreement)
În context, fiind o clauză contractuală, avem acordul părţilor. În dreptul procesual român, competenţa teritorială aleasă de părţi (de obicei prin contract) se numeşte competenţă teritorială convenţională.
