The dynamism of the generics market is also forcing pharma companies to contend with their more aggressive legal strategies to contest IP. Indeed, some are challenging patents years before the forecast date of expiry, in order to take advantage of the six months of marketing exclusivity in the US for the first generic product to be approved (an important period because prices and margins remain high.)

特許薬品（商品）に対する挑戦
ある特許薬品の特許期限がきれますと、それまで、その薬品の特許を所有している会社のみまたはその会社とその薬品に関する特許使用契約をしている企業のみが生産販売に参加できたのですが、他の特許を所有していない会社も特許使用料金を支払わずに、その薬品と同じものを商品名を変えて生産販売できるようになります。もちろん、その薬もアメリカの薬事法にのっとり安全承認を受けなければなりません。特許期限が切れる前は、特許所有企業の独占市場で、価格等もその企業の自由になります。しかし、特許期限切れ以降は他の企業が参加しての自由競争になります。薬品の特許所有企業の商品名をブランドと呼び、特許期限切れ後に同じ薬品ですが、他の企業によって違う商品名で生産販売されるものをジェネリックと呼びます。ご質問の文章は、ジェネリック薬品の特許期限切れ以前からのブランド薬品への挑戦を意味していると存じます。

: This is correct. To challenge a patent means that someone disputes the patent's validity, for ex. saying it includes things that existed before as part of public knowledge, etc. See http://www.bizjournals.com/houston/stories/2002/07/01/newsco...
