bizonyítékok bemutatása/szolgáltatása a saját tanú kikérdezése során
Gyakorlatilag az evidence-in-chief és a case-in-chief szinte majdnem ugyanazt jelenti, annyi a különbség, hogy a case-in-chief az a tárgyalás egy részét jelenti, míg az evidence-in-chief az maga a bizonyíték.
A saját tanúnál visszatértünk a kérdező előző kudoz kérdésére. Azóta is változatlanul kitartok amellett, hogy a magyar jogban a tanú kihallgatása a nyomozati szakaszban történik, ezért itt azt változatlanul nem használnám. Mert ez egy tárgyalás. Teljesen más téma. Pláne azért sem mert az USA jogban tanú kikérdezések vannak. A cross-examinationnél pl. mindenki egyetértett, hogy az keresztkérdezés plusz lásd szótárakat.

A tárgyalás 5 részből áll:
(1) opening statements, (2) the prosecutor's case-in-chief, (3) your case-in-chief, (4) the prosecutor's rebuttal case, and (5) closing arguments.
A case-in-chief:

Prosecutor's Case-in-Chief. The prosecutor's case-in-chief begins the presentation of the evidence in a case. The prosecutor calls witnesses one at a time. The witnesses are sworn and give "testimony" in response to questions from the prosecutor. The prosecutor may also introduce "exhibits" through the witnesses. This initial questioning of the witnesses is called "direct examination". Following direct examination of the witness, you have the opportunity to "cross-examine" the witness. Cross-examination is a time for you to ask questions of the witness, not a time to make statements or argue with the witness. You may introduce exhibits through cross-examination of the prosecutor's witnesses if you wish. When you are finished with cross-examination, the prosecutor has the opportunity to conduct "redirect examination" of the witness--that is, to ask follow-up questions to your cross-examination of the witness. This process repeats itself for each witness until the prosecutor is finished presenting his or her case. When that happens, the prosecutor "rests" or ends its case.

Your Case-in-Chief. You have a decision to make after the prosecutor rests. You have no obligation to testify or present a case. If you choose, however, to present a case, you would present your case-in-chief in the same manner as the prosecutor. That is, you would call witnesses, examine them, have them subjected to cross-examination, and then re-direct examination. You would introduce exhibits, if any, through, your witnesses. If you choose to testify, you lose your privilege against self-incrimination and will be subject to cross-examination as any other witness. This process would continue, one witness at a time, until you were finished presenting your case. Then, you would "rest" your case.

Fontos kiegészítések:
1) A case-in-chief így simán leírva mindkettő lehet: lehet a vád részéről (prosecution) és lehet a védelem (defense) részéről is. Lásd: http://www.ci.gulfport.ms.us/Court_Pro_Se.shtml
2) A szövegkörnyezet alapján a magyar fordításban teljesen felesleges megadni, hogy melyik részről hangzik el a bizonyíték bemutatása, hisz a kérdező által megadott mondatban ott van, hogy melyik félről van szó: "...defense's case-in-chief".
3) Márpedig a defense az a védelem, nem pedig a vád. A vád angolul prosecution.
4) Tehát:
"Before the lead attorney began the defense's case-in-chief, ..."
azaz magyarul:
"Mielőtt a vezető (védő)ügyvéd bemutatta volna a bizonyítékokat saját tanújának kérdezése során, ...
5) Itt tehát nem a vádról, hanem a védelemről van szó.

| Szerintem mind a kettőtöknek igazatok van, én a saját tanú kérdezését nem írnám bele, mert ez nincs benne a szövegben. Egyébként én végül arra jutottam, hogy a bizonyítási eljárás a legjobb megoldás, még akkor is ha szó szerint talán nem ezt jelenti, de ez jól illeszkedik a szövegbe. |

A "case-in-chief" az amerikai jogrendszerben a büntetőpernek az a része, ahol a vád ismerteti a bizonyítékokat. Az adott szövegkörnyezetben a védelem (defense) ismerteti (presents).

Az amerikai jogi rendszer eltér a magyartól, így ennek a szakkifejezésnek szószerinti magyar megfelelője nincs. Az angol jogi definíció megkülönbözteti a "case-in-chief" és a "case" fogalmakat, erre a magyarországi büntető eljárásokban nincs példa. Magyarországon a büntető perrendtartás szerint az ügyet az elnök jelöli meg, a vádat az ügyész terjeszti elő, a bizonyítékokat pedig a vád ismerteti. Az adott szövegkörnyezetben viszont a bizonyítékok védelem általi ismertetéséről van szó szerintem.

158. § (1) A tárgyalást az elnök az ügy megjelölésével nyitja meg.

160. § (1) A tanúk távozása után a terheltet kell a 94. § (1) bekezdése szerint személyi adataira kihallgatni, majd fel kell előtte olvasni a vádirat indítványi részét, szükség esetében egyéb részeit is, illetőleg főmagánvád esetében ismertetni kell a feljelentés lényegét. Az ügyész a 150. § esetében a vádat élőszóval terjeszti elő."
Az amerikai eljárással szemben Magyarországon a bizonyítékok ismertetésére csak a terhelt kihallgatása *után* kerül sor. Bizonyítékokat előbb a vád, majd a védelem ismertet.
"162. § A terhelt kihallgatása után a bíróság lefolytatja a további bizonyítást. A vád bizonyítékai sorrendben rendszerint megelőzik a védelem bizonyítékait; a bíróság azonban a felek meghallgatása után ettől eltérően is rendelkezhetik."

Szerintem súlyos hiba lenne a fordításba belekeverni a "kikérdezés" vagy "saját tanú" kifejezéseket, mert egyik sem játszik jelen esetben szerepet. Találtam még egy definíciót a fentiek mellé:
"After the opening statements, the plaintiff, who has the burden of proving his allegations, begins his case in chief, in which he attempts to prove each element of each legal claim alleged in the complaint (civil) or indictment (criminal). After the plaintiff has concluded his case in chief (and assuming the judge does not dismiss the plaintiff's claim for lack of proof), the defendant presents his case in chief. The defendant presents evidence to refute the plaintiff's proof and establish any affirmative defenses. The defendant may also present evidence to support claims he has against the plaintiff (counterclaims) or third parties (cross-claims)." (Encyclopedia.com)
Tehát általánosságban mind a vád, mind a védelem - mind a felperes/vádló, mind az alperes/vádlott - részéről ismertethetik az ügyet/bizonyítékokat. Az idézett szövegrészletben azonban egyértelműen csak a védelemre történik utalás: "Before the lead attorney began the defense's case-in-chief" - ami magyarul "Mielőtt a vezető ügyvéd megkezdte a védelem bizonyítékainak ismertetését..."

Lehet, túlságosan precíz akartam lenni, mivel az ige nem tartozott szorosan a feltett kérdéshez, az ablakban egy főnév, a case-in-chief szerepel. A további szavakra válaszomban egyenként javasoltam fordítást (presents - ismertet, defense - védelem, stb.)
