: Angenommen, es wäre eine negative Feststellungsklage, dann wäre die Antwort dennoch falsch, weil es ja auch um eine völlig andere Feststellung gehen könnte, in unserem Kontext z. B. um das (Nicht-)Bestehen oder (Nicht-)Verletzen eines Patents.

Discussion
Dafür, dass es ein echter Unterschied ist, spricht jedenfalls die Fülle von Google-Treffern für "non-declaratory relief", wo es ganz klar erkennbar nicht um eine Feststellung geht.
Und da @Schtroumpf gesagt hat, negative Feststellungsklagen gäbe es in F nicht, sollte man vielleicht noch mal überlegen, ob "non-" wirklich "negative" meint ...
Ob diese Interpretation richtig ist, lässt sich ja sicher dem Kontext entnehmen. Welche Klagen wurden von wem erhoben?
