Řekl bych, laicky, že „odmítnutí“ by mohlo sedět:
- co do následků to sedí, protože nevytváří překážku res iudicata
- co do příčin, formální nedostatky jsou u „striking out“ jen jedna z možností
Takže se to nekryje dokonale, ale zdá se mi, že by šlo použít.
„Nedůvodnou“ spíše ne, protože, jak říkám, mohlo jít o formální nedostatky aj.

Řekl bych, laicky, že „odmítnutí“ by mohlo sedět:
- co do následků to sedí, protože nevytváří překážku res iudicata
- co do příčin, formální nedostatky jsou u „striking out“ jen jedna z možností
Takže se to nekryje dokonale, ale zdá se mi, že by šlo použít.
