Scarcity value is the economic factor that increases an item's relative price based more upon its relatively low supply. Whereas the prices of newly-produced manufactured products depends mostly on the cost of production (the cost of inputs used to produce them, which in turn reflects the scarcity of the inputs), the prices of many goods -- such as antiques, rare stamps, and those raw materials in high demand -- reflects the scarcity of the products themselves.

| I've posted a reference comment to share what I found out about the differences between French notaires and US and English notaries. I was surprised to find that there is a very big difference between an English notary public and a US one. An English notary public is a qualified lawyer, while a US notary public, in most but not all states, is not. So, it's not just the difference between civil law and common law jurisdictions. In any event, as this ST is French, the translation has to reflect the French meaning. Also "legal" risks being read as the opposite of "illegal". |

We should probably all take that as a warning to NOT use notary as a translation for notaire, or vice-versa, unless we're talking about a UK notary and translating for UK readers. Fortunately for Aquamarine, in this context it doesn't matter what a "notaire" is because "trame notariale" just means something along the lines of a preprinted legal document or template. |
| I don't think "legal" in "legal document" could ever reasonably be misunderstood as meaning the opposite of "illegal." A legal document, in everyday US English and in legalese, is just a document relating to a transaction (e.g. real estate), court case, administrative legal proceedings, or similar. It could include contracts, deeds, wills, court orders, the contents of a dossier being submitted for an immigration petition, etc. etc. etc. There's no such phrase as "illegal document" so it's hard for me to imagine a reasonable person somehow thinking that "legal document" means the opposite of that nonexistent phrase. |
| We had a similar discussion on a forum recently. The translator has to get around the inequivalences of different legal systems and the reader should know that they are reading a translation. In this case, "legal template" gets around the problem of what a notary might be in different countries and all the pedantic comments, references and "neutral" marks just lose sight of the question. If you start saying that "notaire" does not equal "notary", then you might as well say that "avocat" does not equal "laywer" (different training, different powers). |
