The Committee further notes the author’s argument that any attempt to bring a claim related to the violations he alleges before the courts under the Disability Discrimination Act or the Anti-Discrimination Act would also fail on the basis of the national legislation and jurisprudence on discrimination, thereby excluding the possibility for him to obtain a maximum costs order from a federal court because his claim does not have reasonable prospects of success.

Other suggestions included rewording subparagraph (a) to reflect the idea that a domestic remedy must be exhausted only if there were sound reasons for believing that there was a reasonable prospect of success, or that local remedies need not be exhausted where there was no reasonable possibility of an appropriate remedy.
