: a motion for lack of capacity/interest

Motion [to dismiss] for lack of merit
The word الصفة is a translation of the word "merit" in this kind of context. Usually, such a motion asks for dismissal of the case. Here is one example:

"On March 20, 2002, the RTC issued the assailed Order denyingthe motion to dismiss for lack of merit. Petitioner’s motion forreconsideration was likewise denied in the Order dated April 3, 2003."
