Could even be that "Arbeitsvertrag" is meant with the first AV and "Arbeitsverhältnis" with the second one.
"Working w/o an Arbeitsverhältnis" is not a common term. "Arbeitsvertrag", OTOH, wouldn't fit in gramatically with the second AV.
