Like I say, I think a case could be made for either "facts" or "acts", though I think I would go with "facts" because it is more generic. The report would probably include all of that.

Just to give another option, because I just can't see how facts can be "criminal"--it's the actions that are. They are either refering to facts which are "incriminating" or actions which are seem to be of a criminal nature (alleged crimes).
