7. INDEMNITY.
7.1. Breaching this NDA means serious consequences. In case of unauthorized use or disclosure of any Confidential Information related to the Company’s business or products or any other information that may be deemed as important for the Company, the Recipient shall be entitled to liquidated damages.
7.2. If the Company finds that other Recipient is misappropriating information in some way, penalties for revealing information are as follows:

Penalty for violation of the terms of the NDA - 100,000 USD (for each case of violation), plus:

(a) Expectation damages compensation - putting the non-breaching Party in the same position it would have been if there had been no breach. Calculated by taking the amount of revenue lost by the non- breaching Party caused by the breach.
(b) Restitution damages compensation - breaching Party must return to the non-breaching Party all the profit received as a result of the cooperation, which takes the non-breaching Party to the position it was in before the cooperation.
(c) Recovery damages compensation - the breaching Party pays to the non-breaching Party the costs that the non-breaching has incurred in performing the contract up to the time of the breach.
(d) Disgorgement compensation - the breaching Party pays to the non-breaching Party any amount that it has received during cooperation.
