Mi suona più che altro strano il verbo "to make" alla forma attiva, con un soggetto quale "benchmark" (qui "valore/parametro di riferimento").

"After final disclosure, XXX reiterated its previous arguments and claimed that the use of the relative spread was inappropriate, as the ** benchmark did not make the necessary adjustments ** to reflect the prevailing conditions on the Chinese financial market, and would lead to unreasonable results."
