Vollarbeit

German to English Bus/Financial Business/Commerce (general) On-call working regulations
This term appears several times in my text about the regulations for an on-call service in a company. Employees on the on-call rota may be called in to deal with problems etc. at the company. My Hamblock/Wessels Grosswörterbuch Wirtsschaftsenglisch says that Vollzeitsarbeit is full-time working but this does not seem to fit with the following sentence which is from a section about the remuneration for Tarifmitarbeiter who are called into work on the on-call system and with the breaks which they must have been their periods of work: Die Zeit zwischen der maximalen Vollarbeitszeit (6 Stunden) und der normalen täglichen Arbeitszeit (7,5 Stunden) wird als Arbeitszeit gutgeschrieben.

I do not understand the difference between the Vollarbeitszeit and the normale tägliche Arbeitszeit.

Time actually worked? If Vollarbeit is used to distinguish between time actually worked and time spent on call, I would not use 'full-time' in English. Maybe working time or actual working time?

I don't really understand the part about 'credited'. Has it got anything to do with pay? Afaik, time spent on call (at least when employee has to spend this time on employers' premises) counts towards the maximum weekly working hours, but does not necessarily have to be paid (see 2nd link).

I am not really up-to-date on all this working hours stuff, though.

I assume, there are two regulations/contracts.
1. maximalen Vollarbeitszeit (6 Stunden) - in the company where they have to work
2. normalen täglichen Arbeitszeit (7,5 Stunden) - the time of their employment contracts

Means, they have to work 7.5 hours actually, but the company where they work operates only max. 6 hours.

So the get paid one and a half hour even hough they don't work during that time. (...wird als Arbeitszeit gutgeschrieben.)

Vollarbeitszeit perhaps the wording is a bit misleading. Usually in Germany, employees must take a break after a maximum of 6 hours of work. I.e., they can work through for six hours. Sie können volle sechs Stunden am Stück arbeiten, müssen dann aber eine Pause machen. But what strikes me somewhat strange is that they are the credited with 1.5 working hours. Perhaps this is the bonus for the on-call rota.

The maximum on-call work time is 6 hours, whereas normal working hours are 7.5 (but with a break entitlement), so the remaining 1.5 hours are credited as working time.

My reading of the German is that for on-call employees, the maximum full-time working period is 6 hours, whereas normal employees work 7.5 hours. The other 1.5 hours is probably waiting time (on-call).

This subject is covered by EU worklaw (see link). I have attached a link to a court ruling in Northrhine-Westfalia which matches the situation described.

Basically, the workday is 7.5 hours long excluding breaks. Your man is present at work for 6 hours and after that he is on call for another 1.5 hours. These 1.5 hours are credited to his 7.5-hour working day one-to- one, even if noone calls.

In the court case, the fire department employer tried to have firemen stay on call for 31 hours during the workweek and then only have it count for 15.5 hours. The court said "no": 31 hours are 31 hours and it was in violation of the EU 40-hour workweek law.

Thanks, Nelly and Alexander. This makes it clear. I have just found another sentence in the German which backs up what you have both said: Die maximale Vollarbeitsdauer während der Rufbereitschaft beträgt 6 Stunden.

I can't actually see the term of Vollarbeit in the question, except with the extension of -zeit, but think this is an equalisation of union, collectively agreed internal/ innerbertrieblich (6 hours) vs. industry-wide/ Branchen-Tarif - hours and the normal 7.5 hours contract employment time.

The time inbetween still counts as 'fully payable employment'.

So there is a sort of Tarifangleichung outside of the indsutryl

1. Wechseln sich Berufskraftfahrer auf längeren Touren als Fahrer und Beifahrer ab, so sind die Zeiten als Beifahrer als Bereitschaftszeiten vergütungspflichtig.

2. § 21 a Abs. 3 Nr. 3 ArbZG steht dem nicht entgegen, da diese Vorschrift nur die "arbeitszeitschutzrechtliche" Herausnahme dieser Zeiten von den Arbeitszeiten regelt, nicht aber Regelungen über die Vergütungspflicht enthält.

3. Für Bereitschaftszeiten kann - individualrechtlich oder kollektivrechtlich - eine geringere Vergütung als für "Vollarbeitszeit" vereinbart werden (BAG vom 12.03.2008 - 4 AZR 616/06); ist dies nicht geschehen, sind sie wie Vollarbeitszeit zu vergüten.
