Nu cunosc prea multe detalii, însă în România succesiunea trebuie acceptată, pentru care există un termen. Despre acest termen e vorba aici.
(În Ungaria, spre exemplu, dacă nu se exprimă refuzul, succesiunea se consideră acceptată automat. La noi e invers.)

Cred că e mai corectă varianta acceptance of succession. Heir se numeşte după acceptarea succesiunii, în unele ţări.

Subliniem faptul că termenul de opţiune succesorală presupune scurgerea unei perioade de timp ce îi conferă succesibilului posibilitatea de a se decide în cunoştinţă de cauză, iar în conformitate cu prevederile art. 1103 alin. 1 Codul Civil, ”dreptul de opţiune succesorală se exercită în termen de un an de la data deschiderii moştenirii”. (nu ştiu dacă nu e cumva CC vechi, dar oricum n-are importanţă pentru clarificare)

În ceea ce priveste repunerea în termen în materie succesorala, prin art. 700 alin. 2 cod civil s-a stabilit ca „în cazul când mostenitorul a fost împiedicat de a se folosi de dreptul sau, din motive de forta majora, instanta judecatoreasca, la cererea mostenitorului, poate prelungi termenul cu cel mult 6 luni de la data când a luat sfârsit împiedicarea”.
