General Terms and Conditions

Except as otherwise explicitly provided in this Standard Possession Order, the terms and conditions of possession of the child that apply regardless of the distance between the residence of a parent and the child are as follows:

1.

Surrender of Child by Custodial Parent - Custodial Parent is ORDERED to surrender the child to Non-Custodial Parent at the beginning of each period of Non-Custodial Parent's possession at the residence of Custodial Parent.

2.

Surrender of Child by Non-Custodial Parent - Non-Custodial Parent is ORDERED to surrender the child to Custodial Parent at the residence of Non-Custodial Parent at the end of each period of possession.

3.

Surrender of Child by Non-Custodial Parent - Non-Custodial Parent is ORDERED to surrender the child to Custodial Parent, if the child is in Non-Custodial Parent's possession or subject to Non-Custodial Parent's control, at the beginning of each period of Custodial Parent's exclusive periods of possession, at the place designated in this Standard Possession Order.

A. A person taking a child into custody pursuant to the provisions of subsection A of § 16.1-246, during such hours as the court is open, shall, with all practicable speed, and in accordance with the provisions of this law......

B. A person taking a child into custody pursuant to the provisions of subsection B, C, or D of § 16.1-246, during such hours as the court is open, shall, with all practicable speed, and in accordance with the provisions of this law and the orders of court pursuant thereto:

1. Release the child to such child's parents, guardian, custodian or other suitable person able and willing to provide supervision and care for such child and issue oral counsel and warning as may be appropriate; or

2. Release the child to such child's parents, guardian, legal custodian or other person standing in loco parentis upon their promise to bring the child before the court when requested; or

neutral LilianNekipelov : Surrender--after a visit not before. But even then, it is hardly ever used. "To surrender a child' means something else, usually--like giving up your parental rights.
