Italian term

comunione

Italian to English Law/Patents Law (general) Court proceedings
Hello,

I am having trouble understanding the meaning of "comunione" in the particular context in which it appears here below (I know that the term has been addressed in previous Kudoz posts, but I don't think they are relevant here):

Incidendo l'accordo stragiudiziale sul diritto sostanziale allo scioglimento della ***comunione*** qui fatto valere, non puo' che darsi atto del venir meno delle parti alla prosecuzione del giudizio rendendosi pertanto superflua ogni ulteriore decisione da parte di questo giudice sulla domanda originariamente avanzata.

The case in question relates to a single plaintiff claiming compensation against multiple defendants following an injury. The paragraph above appears in the context of a declaration by the plaintiff and one set of defendants that they have reached a settlement. I assume that "comunione" essentially means the relationship between the parties....but I wonder if anyone has any specific suggestions on how to translate it?

Thanks!

Italian term (edited): (scioglimento della) comunione
Selected

(disbandment of the) confederate group (of defendants)

The answr might be contained in the clue of the set of defendants.

A group of claimants in a litigation scenario would bring a class or group action as (BE) 'privies' or (AE) 'confederates'. But a 'litigation group' would be an association or dept. within a law firm.

Best prefix the scioglimento as can turn the 'communion' into the severance of a joint tenancy (ownership) of marital or matrimonial property or termination of marital consortium (right to mutual company and support etc.)

4 KudoZ points awarded for this answer. Comment: "Thanks Tom, this helped a lot!"

sharing/division

Suggestion; The first is taken from this reference :http://iate.europa.eu/SearchByQuery.do, but only sharing as your case does not involve married parties; second reference is taken from : http://forum.wordreference.com/showthread.php?t=45715 and again does not involve community of assets

I'm not very sure about it though. Let's wait for those who know more about law, as the next part is confusing
