I am translating a document that lists a large number of offences that a company can commit against the public administration. The phrase "Tale fattispecie può realizzarsi" occurs again and again when describing the offences that can be committed, as in:
"*Tale fattispecie può realizzarsi* nel caso in cui si pongano in essere artifici o raggiri, ad esempio comunicando dati non veri o predisponendo una documentazione falsa, per ottenere finanziamenti pubblici."
The meaning is clear, but I am at a loss for a compact legal phrase that I could use in English. All suggestions are welcome.

This type of offence may occur
I imagine this is legislative decree 232/2001. After translating pages and pages of this stuff, as I remember the fattispecie in question were different types of offences which are listsed one after the other.

Such a result may occur
can replace result with situation or eventuality, depending upon context (not clear here)
Peer comment(s):

Carl Stoll
: "result" is too mild and too vague. "Fattispecie" clearly implies a criminal offense.

: Disagree with Carl. It just means a situation or instance. http://dictionary.reverso.net/italian-english/fattispecie

these facts can occur simultaneously, thus constituting a criminal offense
"Fattispecie" is translated as "elements of an offense," "corpus delicti", or "facts of the case" (www.leo.org).
Perhaps "these conditions can be fulfilled, thus ..."

Phil Goddard pointed out that "facts do not occur". Consequently I am altering my suggestion to "these facts can concur in certain cases, thus constituting a criminal offense" Or else use "arise" instead of "occur".
