French term

sous réserve

French to English Law/Patents Law (general) from a written transcript
Hi all -

I was wondering how this seemingly simple legal phrase translates into English...

Here is the whole context:
De plus, les questions sur la recherche et le développement sont sous objection mais on va laisser le témoin répondre sous reserve.

My best guess:
Furthermore, the questions about research and development are subject to objection (?) but we will allow the witness to answer _______.

Any suggestions would be greatly appreciated!

Thanks!

Discussion

Michael Meskers (asker) Jan 11, 2013:
sous réserve - more context It is a transcript of a legal deposition. The term appears repeatedly when someone is about to speak, usually right after their name. For example:
Me Dupont (sous réserve): "blah blah blah"
philgoddard Jan 11, 2013:
Please could we have the full context, ie what the document is about and what it says before and after this.

@ opera1 : I just noticed your discussion entry and suggest "under advisement" as an alternative that would fit better in the context of: Me Dupont (sous réserve): "blah blah blah."

Here's an English language source:

The matter in NAC rose out of a tendering process for which the plaintiff was seeking damages, In discovery, counsel for NAC questioned the Commission's representative concerning three matters related to communications between a consultant and the Commission. Each question was objected to and taken under advisement. The commission later declined to disclose the information requested.

At least in some instances, the witness may be asked to answer the question, the objection noted, and the issue subsequently taken under advisement.

Note from asker:
My tendency after searching, asking a lawyer (US based) and reading all the these VERY helpful responses was to go with "without prejudice" after all. However a Canadian lawyer colleague told me in Canada they use "under reserve." Yet my Google searches haven't confirmed that for me... Confondu...

4 KudoZ points awarded for this answer. Comment: "without prejudice seems to be the most generally applicable answer. However this Canadian government site: http://www.ae-ei.gc.ca/cgi-bin/recherche/ae/gen/recherche-fra.aspx?p1=sous+reserve&p3=internet01_fra&p5a=d&p5b=4&p5c=a&p7=2 gives "under advisement" which was also suggested here in a comment. Thanks for all the helpful answers!"
