Grammar The "en caso que..fuese" and then the future "estará" clearly demonstrate that this text cannot possibly be referring to one specific claim, but to a general contractual provision.

agree philgoddard : I think this makes more sense because as I understand it, the lawsuit already exists, and the insured has to become a party to it on request by the insurer.

disagree Edward Tully : no, the "en caso que" makes it clear that this is just a general provision for the future//Really? you replied "that's the idea" to Phil, and "the suit" (your words) could only refer to an already existing case. Please clarify in the discussion.

So what's your problem? Phil is the one that says the lawsuit already exists, not me. It refers to a potential claim.
