I though of "dropping claimant". I tried googling it; it does not seem to be a frequent phrase or a legal term. I am not sure. Maybe somebody comes up with a better suggestion?
Note from asker:

In civil actions, it's usually a "Plaintiff" who initiates the proceedings.
When talking about charges for offences, the proceeding is typically initiated by an informant or complainant.
It depends on your context.

If it's the State that initiat the proceeding in a criminal case, it is then the District attorney or prosecutor.
