Hi there, I'm currently working on a "Contrat Cadre de Vente". The phrase I am unsure about is as above "Societe en Nom Commercial". I'm not sure how I would phrase this is English or what kind of company this is referring to. This only appears the once at the start of the document in the following context:
La societe XXX
Societe en Nom Commercial au capital de XXXX
Dont le siege est situe au XXXX
Immatriculee au RCS de XXXX sous le numero XXXX
It does not appear again in the document and I haven't come across it before. I've tried googling the term but haven't managed to find it as a set phrase- I find "societe en nom collectif" and then "societe" closely linked to "nom commercial" but not appearing exactly as above. Any ideas most appreciated!! Many thanks...

I suspect they've simply worked a variant of société en nom collectif, which is by definition a société de personnes qui a un objet commercial (as opposed to, say, a sociéte non commerciale). In any case, the Anglosphere equivalent is likely to be a 'partnership' or 'firm' as opposed to a 'company'.
Generally in English, entities are qualified as 'non-trading', 'professional', etc. only if they are NOT 'commercial'. You can usually leave this adjective out.

I think it is rather clumsy. There is of course "Trading Name" but I'm sure they don't mean that.

I did find a couple of references to this here: http://www.abanet.org/buslaw/corporateresponsibility/clearin... and here http://www.juristudiant.com/site/fiches/Juristudiant-procedu... where they say an SNC is a "société en nom commercial" but like you I've always come across it as a "société en nom collectif".
