Jose: One can object to the jurisdiction of an administrative agency. For example, the US SEC may decide to take some kind of action against a bank and the bank may object to its jurisdiction, claiming that the matter is within the scope of a different agency (say the FDIC).

Would translating "social" as "administrative" or "administrative agency" before the word "jurisdiction" clarify things?

Yes Alex, but the objection is not to the jurisdiction, is against the resolution. Maybe the Spanish wording is a bit confusing, but it means that the objection (to the resolution) is prior to the court action. "Jurisdicción Social" means Courts with jurisdiction in Labour matters.

Derecho procesal laboral: a prelim. admin. channel akin to a pre-action letter in the UK. Real Decreto Legislativo esp. 2/1995, de 7 de abril, texto refundido de la Ley de procedimiento laboral, articulos 69 y siguientes.

Perhaps you may be able to word this differently, but in this specific context your text refers to appealing (actually petitioning for the review of) a decision of the Spanish labor authorities (Ministry of Labor), prior to seeking a remedy (appealing the decision) in the labor courts (calle here "vía jurisdiccional social").

This is definitely a "Spain-specific" question, and in the event this proves useful, the procedure is described as follows:

La doctrina administrativa destaca el carácter jurídico-administrativo de la reclamación previa como institución que forma parte del Derecho Administrativo. Del art. 120.1 de la Ley de Régimen Jurídico de las Administraciones Públicas se deduce que su regulación se encuentra fundamentalmente en dicha norma. Se trata de un procedimiento administrativo especial, que concluye en una resolución sobre materias reguladas por el ordenamiento laboral, como presupuesto procesal de la acción laboral, sin posibilidad de recurso administrativo ni impugnado en el orden contencioso-administrativo, salvo que durante la tramitación surjan vicios, irregularidades o incidencias.

La reclamación previa consiste en una pretensión dirigida a la Administración con el fin de que ésta dicte un acto administrativo resolutorio que responda a dicha pretensión. Su naturaleza varía según haya existido o no previamente un acto administrativo al que pueda hacer referencia la reclamación, tratándose de pretensión inicial, en el primer caso, y de pretensión en vía de impugnación, en el segundo.

El procedimiento varía en cada caso. Si no ha existido acto administrativo previo, y la resolución es negativa, se crea el presupuesto procesal exigido para acceder a la Jurisdicción Social, se apura la vía administrativa, pero si le precedió un acto administrativo a la pretensión, ésta al impugnarlo agota la reclamación previa.

El art. 120.1 citado reconoce la reclamación previa al ejercicio de acciones fundadas en derecho laboral, de la misma manera que el art. 69 de la Ley de Procedimiento laboral, como requisito esencial del proceso, que pone en conocimiento del órgano administrativo el contenido de la pretensión y darle ocasión de defensa, y si es posible, evitar el pleito.
