A company has gone bankrupt and a court has appointed a "commissaire à l'exécution du plan de cession" to organise the sale of the business. How could this be translated?

receiver I don't think this is the same - I have used "receiver" to translate "administrateur judiciaire".

now that I see you haven't used "administrator" for "administrateur".

This "plan de cession" is a fairly recent innovation (along with "plan de continuation"). It clearly is a less drastic process than receivership or liquidation.

Transfer plan enforcement administrator

"Commissaire" is most likely to be an administrator in this case. Not sure about "plan de cession". I can't think of a better alternative.

In Canada, they are called receivers (short form of receivers in bankruptcy)

Well, lots of confusion: you\'re right - I found receiver for administrateur judiciaire. I entered commissaire and hunted around a bit and found commmissaire de faillite = commissioner in bankruptcy.

neutral Nikki Scott-Despaigne : The problem here is that the court may also appoint the creditors' representative to be the "commissaire à l'exécution du plan". NB "winding up" rather than down for the England and Wales anyway.

the commissioner in charge of the asset disposal plan

This person, appointed by the court, is in charge of disposing assets in the best interest of the creditors. It generally involves selling off sellable bits, cutting the workforce and hanging on to the most profitable areas. The receiver or the creditors’ representative may be appointed to act. He has to present a plan for the disposal of assets to the court which the court may accept or refuse. A kind of last ditch attempt to keep some part of the business ticking over, by shedding the weighty parts which are driving the business into the ground. These plans sometimes work.

In view of the differences between the way each country handles such matters (and here I’m talking just about Europe, cf. http://conventions.coe.int/Treaty/FR/Treaties/Html/136.htm), trying to find parallels is tricky. Given the task he has to undertake, and the fact that it may be either the receiver or the representative, the way these tasks are dealt with in France is France-specific, I think that the most practical solution from your client’s point of view may well lie in a fairly literal rendering : the commissioner in charge of the asset disposal plan.

Commissaire à l'exécution du plan
Le tribunal nomme pour la durée fixée à l'article L. 621-66 à laquelle s'ajoute éventuellement celle résultant des dispositions de l'article L. 621-100 ci-après un commissaire chargé de veiller à l'exécution du plan. L'administrateur ou le représentant des créanciers peut être nommé à cette fonction. Le commissaire à l'exécution du plan peut être remplacé par le tribunal soit d'office, soit à la demande du procureur de la République.
Les actions introduites avant le jugement qui arrête le plan soit par l'administrateur, soit par le représentant des créanciers, sont poursuivies par le commissaire à l'exécution du plan.
Le commissaire à l'exécution du plan peut se faire communiquer tous les documents et informations utiles à sa mission.
Il rend compte au président du tribunal et au procureur de la République du défaut d'exécution du plan. Il en informe le comité d'entreprise ou, à défaut, les délégués du personnel.
