French to English Law/Patents Law: Patents, Trademarks, Copyright earrings
I am not sure how to translate this in the context of an alleged case of infringement relating to a design of earrings:

"en revanche, de la comparaison des deux autres modèles, il ne ressort pas que la contrefaçon soit établie du fait des différences existantes entre les modèles, le surmoulage allégué n'étant pas établi, particulièrement en ce qui concerne la partie basse du modèle."

Here is a link to an article on overmolding http://bdbill.iweb.bsu.edu/overmolding.htm. It doesn't really sould like somthing used in jewelry making. I bet it is molding from a casting, since this would be the easiest way to copy someone elses design.

The text doesn't actually go into the technical details of how the earrings are copied.

Does it actually appear from the text that the infringer is being accused of making a cast from the plaintiffs earrings? If so molded/moulded from a casting might be better. Overmolding (US sp) refers to a specific two-part molding process.
