Discussion

Sonja Allen (asker) Feb 15, 2008:
Just for a better understanding of the civil procedure: the claimant sends in the claim form to the court which then processes the claim and puts a case number and issue date on it. This issue date is then "official" and the period allowed for serving the document to the defender counts from this issue date on.
Brie Vernier Feb 15, 2008:
Ah! Of course I completely overlooked the first instance : (
Sonja Allen (asker) Feb 15, 2008:
Brie You might be right in the second instance, however the claim was also "issued" after it was sent to court, so I assume it has something to do with the claim becoming effective or being made official or so
Brie Vernier Feb 15, 2008:
As I understand it, issue is not a verb here, but a noun -- the matter to which the claim related.

Klage einreichen

Thanks for further details - in this case I would translate as follows:

We forwarded our client´s claim to you on 31 July and it was issued on 3rd August" => Wir haben die Klage unseres Klienten am 31. Juli an Sie weitergeleitet, sie wurde am 03.August registriert (case number and date put on it)

"issue" in the second sentence means Streitfall, Grund der Klage

issue

I think, it is a verb in the first sentence and a noun in the second (issue - Anglegenheit, Streitfrage)

Hope, I could give you an idea

Note from asker:
Thanks for the useful link. However, according to it, a claim is only "erhoben" once it has been served (to the defendant) which in my case has not yet happened be "erhoben".
