Deze omstandigheden kunnen dan ook niet leiden tot het oordeel dat er sprake is van eigen schuld.

I have found in my legal dictionary "circumstances which can be imputed to the victim", but as this is a civil case I don't think it is appropriate here. Any takers?

OK, it misses out the "eigen" bit, but that should become clear from the context.

contributory negligence

Volgens mij komt eigen schuld overeen met contributory negligence in common law (http://en.wikipedia.org/wiki/Acts_of_the_claimant). Tony Foster, Dutch Legal Terminology in English, geeft het ook in het hoofdstuk over rechtmatige en onrechtmatige daden.
