Das Verwaltungsgericht hätte eine Verfolgungsgefahr aber auch dann bejahen müssen, wenn hierfür der Prognosemaßstab einer beachtlichen Wahrscheinlichkeit zugrunde zu legen gewesen wäre.

literally: if the predictability criterion for this were based on a high probability ....just a literal translation and not meant to be taken seriously ... there's an element of tautology in there IMO and I think you can quite happily go with what I suggested above or something like "if there were a high probability of the underlying predictability criterion being met" (although this sounds a little forced) .....

criterion

It's unclear from the single sentence what the "Prognose-" means. You might need "criterion for predicition" or "prediciton criterion," but I think that a simple "criterion" will fit.
