German term

Minderwert

Homework / test German to English Law/Patents Law: Contract(s) Terms and Conditions
Hi all,

I've found this in the glossary, but it's not exactly what I'm looking for. Some context:

"Ist eine Mangelrüge rechtzeitig and berechtigt, so sind wir nach unserer Wahl berechtigt, den MINDERWERT zu vergüten, vom Vertrag zurückzutreten oder Ersatzweise zu liefern."

...to reimburse the the reduced value, perhaps?

Any advice/suggestions are much appreciated!

Join the club. This is turning out to be a nightmare - red-rimmed eyes at a late hour... with Verkaufs- und Lieferbedingungen!
Agnieszka Hayward (X) Aug 29, 2005:
no problem. I changed it to pro for you. I was just wondering, whether the question was really very simple only I wouldn't see it, because I'm too tired :o)
Non-ProZ.com Aug 29, 2005:
I apologise. I did have this as pro, but the settings did not keep when I modified the question. I'll be more careful next time.
Agnieszka Hayward (X) Aug 29, 2005:
why non-pro?

make good/compensate for the reduction in value

It's not the new, lower value of the goods that they pay, but the amount by which the goods have been reduced in value. In other words, if the goods in perfect condition would be worth X, but because of damage they are only worth Y, they will pay out X-Y. That's how I see it.
Peer comment(s):

agree Derek Gill Franßen : Good explanation. If the product is defect, the buyer (who has already paid) can demand a refund of the amount paid exceeding the actual value of the (defect) product - also known as "diminution of the (purchase) price" (cf. "Minderung" bei Romain). :-)

reduced market value

I am guessing - found this in Leo.

I think it means that they are entitled to credit/refund only the value of the goods in their damaged/repaired state - although WHY, I don't know.
