ok but a) I would end differently with ".... be applied publicly or privately against said disturbance. b) I still prefer MAY over SHALL which is to ultimative in tone. The original is talking of the possibility i.e. MAY BE, not of the finality WILL BE

"prosecution" suggested by you

agree Ana Brause : El único cambio que le haría es utilizar el término equity en lugar de fairness (by Law and Equity), refiere a recursos que se presentan en tribunales especiales. Aparece el término equidad cuando la versión va y vuelve del inglés.

It looks like "public or private" pertains to the nuisance.
