There is nothing wrong with "tener en cuenta" but "tener presente" would emphasize "awareness" rather than, as in the former case, "intention". It is a question of which nuance you prefer.
By the way, the English is rather strange. If "consults" makes any sense at all in such a context than it is surely an archaism.
