The genes are inherited and determine the growth, development and way of functioning of your body. For instance, some genes control the colour of your eyes or hair. Scientists have learnt a lot about how genes work. There are a lot of differences or variations in the DNA of one person to another. These variations can influence the chances of a person to suffer from a certain disease or the way a person reacts to a certain drug. You are asked to donate a blood sample for genetic research which will determine part of your DNA structure and will allow us to compare it with your medical records which we possess. You are asked to do this because you are already taking part in a clinical study entitled “Randomized ,Double-blind, Placebo-controlled Phase Study III. for the Evaluation of the Efficacy and Safety of 10mg ZD4054 in Association with Docetaxel Compared to Docetaxel ,at Patients with Metastatic Hormone- resistant Prostate Cancer, what we are going to call “principal study” in this document hereinafter. We are going to use the phrase “ this genetic research” in order to refer to the genetic research you are now invited to take part in.

Source text - English An innuendo meaning (in the technical legal sense) is something more than a meaning that can be implied from the words complained. It is a meaning which can be implied from the words complained of, but only if the reader also knows other facts (which are not general knowledge). These are generally called extrinsic facts.
In respect of an innuendo meaning, a claimant must, in addition to identifying the meaning complained of, prove the extrinsic facts relied upon and prove that these facts were known to readers. The claimant will have been defamed in the minds of those readers, but not in the minds of the readers who did not know the extrinsic facts.
There may be an issue between the parties whether the circumstances of a publication amount to extrinsic facts, which have to be proved as such to support an innuendo, or whether they are general knowledge, which can be relied on in support of its natural and ordinary meaning. Either way, the court must find that the facts are known to the reader.
In the present case there is no dispute about the truth of the fact that the Claimant was a prominent Conservative politician from the Thatcher years. The issue is as to whether any reader of the Tweet knew who the Claimant was.
In the present case the Tweet would mean little to a reader who had no knowledge of any of the Claimant, of the Newsnight broadcast or of the media reporting of the Newsnight broadcast in the period immediately preceding the Tweet. So in the present case I have to decide whether the Newsnight report and the media reporting are to be treated as part of the general knowledge of the Defendant’s followers who read the Tweet on 4 November 2012, or whether they are to be treated as extrinsic facts, that is to say, knowledge that would be known only to a limited number of people. If they would be known only to a limited number, then the Claimant must prove that there were readers in that number, and how big that number was.
In cases where the extrinsic fact is obscure a claimant will have to adduce evidence from witnesses or documents to prove that the readers of the words complained of knew the extrinsic facts. But in other cases a claimant may rely on an inference prove that some readers had the necessary knowledge of the extrinsic facts.
In Fullam v Newcastle Chronicle & Journal Ltd the plaintiff complained that an article in a local newspaper meant that he had fathered an illegitimate child. But the meaning in question could only be understood by readers of the newspaper who knew facts about the plaintiff’s wife and child (the date of the marriage and the date of the birth) which were not set out in the article he complained of. At 659 Scarman LJ explained:
“There may well be cases in which it would not be necessary to plead more than the fact of publication by newspaper and the extrinsic circumstances, leaving it to be inferred that there would be readers with knowledge of the facts [about his wife and child].
For instance, the facts may be very well known in the area of the newspaper's distribution — in which event I would think it would suffice to plead merely that the plaintiff will rely on inference that some of the newspaper's readers must have been aware of the facts [about his wife and child] which are said to give rise to the innuendo.”
In the present case the Claimant’s primary case is that his having been a politician, the gist of the Newsnight report, and the reporting of it by the media, were so well known to Twitter followers generally that these facts should be treated as part of their general knowledge. If he is wrong about that, his alternative case is that he relies on inference. He submits that the court should infer that there probably were some readers who knew these facts, as explained in the Fullam case.
The legal principles to be applied when determining the question of meaning are in part derived from the Rubber Improvements case. They were summarised by Sir Anthony Clarke MR in Jeynes v News Magazines Limited (where “he” means “he or she”): “The legal principles relevant to meaning have been summarised many times and are not in dispute.... They may be summarised in this way: (1) The governing principle is reasonableness. (2) The hypothetical reasonable reader is not naïve but he is not unduly suspicious. He can read between the lines. He can read in an implication more readily than a lawyer and may indulge in a certain amount of loose thinking but he must be treated as being a man who is not avid for scandal and someone who does not, and should not, select one bad meaning where other non-defamatory meanings are available. (3) Overelaborate analysis is best avoided. (4) The intention of the publisher is irrelevant. (5) The article must be read as a whole, and any “bane and antidote” taken together. (6) The hypothetical reader is taken to be representative of those who would read the publication in question.”
It is important in this case to stress point (6). The Tweet was not a publication to the world at large, such as a daily newspaper or broadcast. It was a publication on Twitter. The hypothetical reader must be taken to be a reasonable representative of users of Twitter who follow the Defendant. What the characteristics of such people might be is in part agreed, and in part for submissions by the parties as to what I should infer from what is agreed.
The Defendant’s tweets which are in the court bundle include a number which relate to politics or current affairs as well as a number which do not. Because of that, and because of her political links, Sir Edward submits that followers of the Defendant probably included a significant number who shared her interest in politics and current affairs. A significant number retweeted the Tweet to their own followers. The fact that the Defendant’s followers use Twitter implies that they like to be up to date with such matters. I did not understand Mr McCormick to dispute this, and I would infer that it is the case.
Translation - Romanian Sensul unei aluzii (în sens tehnic juridic) este ceva mai mult decât un sens care poate fi subânţeles din formularea plângerii. Este un sens care poate fi subânţeles din cuvintele la care se referă plângerea, dar numai dacă cititorul are de asemenea cunoştiinţă şi alte fapte (care nu sunt din domeniul cunoştiinţelor generale). Acestea în general sunt denumite date extrinseci.
Cu privire la sensul unei aluzii, pe lângă identificarea înţelesului formulării din plângere, un reclamant trebuie să dovedeasca faptele extrinseci pe care se bazează aceasta şi să dovedească că acestea erau cunoscute de către cititori. Reclamantul va fi fost defăimat în mintea acelor cititori, dar nu şi în minţile cititorilor care nu avuseseră cunoştiinţă de faptele extrinseci.
Ar putea exista o controversă între părţi privind întrebarea dacă circumstanţele publicării sunt echivalente cu fapte extrinseci, care ar trebui să fie dovedite ca atare pentru a susţine o aluzie , sau reprezintă cunoştinţe generale, care ar putea fi invocate în sprijinul înţelesurilor sale obişnuite şi fireşti. În ambele cazuri, instanţa trebuie să afle dacă aceste fapte sunt cunoscute cititorului.
În speţa de faţă nu se contestă veradicitatea faptului că Reclamantul a fost un politician conservator reputabil din perioada Thatcher. Problema este dacă vreun cititor al mesajului de pe Twitter şi-a dat seama cine era Reclamantul de fapt.
În cazul de faţă, mesajul de pe Twitter n-ar avea semnificaţie pentru un cititor care încă nu auzise mai nimic de vreunul dintre următoarele: de Reclamant, de reportajul din emisiunea Newsnight sau de preluarea în media a reportajului Newsnight în perioada imediat anterioară mesajului de pe Twitter. Astfel, în speţa de faţă, trebuie să decid dacă reportajul Newsnight şi preluarea lui în mass-media trebuie considerate ca făcând parte din cunoştinţele generale ale abonaţiilor Pârâtei şi care au citit mesajul de pe Twitter din 4 noiembrie 2012, sau dacă trebuie considerate ca fiind fapte extrinseci, adică, cunoştinţe ale unui număr limitat de persoane numai. Dacă acestea ar fi cunoscute numai de un număr limitat de persoane, atunci Reclamantul trebuie să dovedească faptul că au existat cititori în acel număr şi să arate cât de mare era acel număr.
În cazurile în care faptele extrinseci sunt obscure, un reclamant ar trebui să aducă mărturii sau documente în susţinerea faptului că cititorii cuvintelor la care se referă plângerea aveau cunoştiinţă despre faptele extrinseci. Dar în alte cazuri, un reclamant se poate baza pe o deducţie logică pentru a dovedi că unii cititori aveau cunoştintele necesare despre datele extrinseci.
În speţa Fullam c. Newcastle Chronicle & Journal Ltd, reclamantul s-a plâns că un articol dintr-un ziar local a lăsat să se înţeleagă că el a procreat un copil nelegitim. Dar sensul contestat putea fi înţeles numai de către cititorii ziarului care aveau deja cunoştiinţe de anumite fapte în legătură cu soţia şi copilul reclamantului (data căsătoriei şi data naşterii), care n-au fost menţionate în articolul la care se referea plângerea. La punctul 659 judecătorul Curţii de Apel, Scarman, a explicat:
“Ar putea exista de a binelea speţe în care nu ar fi necesar să se pledeze mai mult decât faptul publicării de către un ziar şi circumstanţele extrinseci, lăsând să se înţeleagă că există cititori care au cunoştiinţă despre aceste fapte [despre soţia şi copilul său].
De exemplu, faptele ar putea să fie cunoscute foarte bine în zona de distribuţie a ziarului – caz în care cred că ar fi suficient să se pledeze numai că reclamantul se va baza pe concluzia logică potrivit căreia unii dintre cititorii ziarului ar fi trebuit să fie la curent cu faptele [despre soţia şi copilul său] despre care se afirmă că generează aluzia.”
În speţa de faţă, argumentul principal al Reclamantului este faptul că fiind politician, esenţa reportajului Newsnight, şi preluarea acestuia de către mass-media, era atât de binecunoscută abonaţiilor Twitter în general, încât aceste fapte ar trebui să fie tratate ca făcând parte din cunoştinţele lor generale. Dacă se înşeală în această privinţă, argumentul său alternativ ar fi că s-bazat pe deducţie logică. El susţine că instanţa ar trebui să deducă faptul că existau probabil câţiva cititori care au avut cunoştiinţă de aceste fapte astfel cum este explicat în speţa Fullam.
Principiile juridice care trebuie aplicate în soluţionarea chestiunii înţelesului sunt în parte derivate din speţa Rubber Improvements. Acestea au fost rezumate de Sir Anthony Clarke, Preşedintele Curţii de Apel, în Jeynes c. News Magazines Limited (unde “el” se va se citi ca “el sau ea”): “Principiile juridice relevante pentru semnificație au fost rezumate de multe ori şi nu sunt disputate.... Ele pot fi rezumate astfel: (1) Principiul de bază este rezonabilitatea. (2) Cititorul ipotetic rezonabil nu este naiv, nici nu este suspicios în mod nejustificat. El poate citi printre rânduri. El poate deduce un înţeles implicit cu o mai mare uşurinţă decât un avocat şi se poate bucura de o mai mare libertate de gândire, dar el totodată trebuie considerat ca fiind un om care nu este avid de scandal şi ca cineva care nu reţine, şi nu ar trebui să reţină un anume înţeles negativ atunci când alte înţelesuri nedefăimătoare sunt la îndemână. (3) Analiza prea aprofundată ar trebui evitată. (4) Intenţia editorului nu este relevantă. (5) Articolul trebuie citit în întregime, şi orice „otravă şi antidot” trebuie împreună luat în considerare. (6) Cititorul ipotetic este considerat reprezentativ pentru cei care ar citi publicaţia în cauză..”
În speţa de faţă, ar fi important de subliniat punctul (6). Mesajul de pe Twitter nu era o publicaţie pentru publicul larg cum ar fi un cotidian sau o emisiune TV. Acesta a fost o publicare pe Twitter. Cititorul ipotetic trebuie considerat ca fiind un reprezentant rezonabil al utilizatorilor Twitter care sunt abonaţii Pârâtei. Caracteristicile presupuse ale unor astfel de persoane sunt în parte acceptate şi în parte supuse probelor aduse de părţi cu privire la cea ce ar trebui să deduc din ceea ce este acceptat.
Mesajele de pe Twitter ale Pârâtei, care sunt cuprinse într-un pachet supus instanţei pentru analiză, includ o serie care se referă la politică sau actualităţi, precum şi o serie care nu se referă la acestea.
Din această cauză, şi datorită legăturilor sale politice, Sir Edward susţine că printre abonaţii Pârâtei se găsesc probabil un număr important de persoane care îi împărtăşeau interesul pentru politică şi actualități.. Un număr important de persoane a retransmis mesajul de pe Twitter pentru proprii lor abonaţi. Faptul că abonaţii Pârâtei folosesc Twitter , sugerează că le place să fie la curent în aceste domenii. Nu am înţeles ca dl. McCormick să fi contestat acest raţionament şi mi-aş deduce că acesta este situaţia.

I am a professional in Business, Law and Physics, under Business in understand also Economics and Finance. I was awarded an MA in Economics from the University of Essex, Colchester (in the top 5 in the UK in this field) and from the Central European University, a US accredited English language and very prestigious graduate school in Budapest. I have benefited of full scholarship and got personal greetings from Mr.George Soros himself.
Besides this I am a professional in Law, generally in Business law, especially in Contract law,Intellectual property rights and Securities. I have an MA equivalent in continental law from the European University, specialised in civil law and international law but I am equally familiar with criminal law. I am also a court interpreter in these three languages : English, Hungarian, Romanian.
I have finished my Ph. D studies in Economics and Law ,focusing on commercial contracts. I am working currently as an interpreter and translator and as a part-time university lecturer, teaching International business law, Corporate Finance, Micro and Macroeconomics. I have taught so far Commercial law,Public finance, Accounting, Investments, International trade,Statistics,Business ethics also for 7 years up till now ,being a full-time university lecturer then an associate professor. This activity comprised teaching at universities in three countries , while for another 12 ,I was a high school teacher of Physics and Mathematics, in two countries.
I have also an MSc in Physics, from the Babes Bolyai University, all my three degrees were achieved on day-course basis,totalling 12 years.
