Metode penelitian yang digunakan adalah metode kualitatif dengan pendekatan studi kasus. Studi kasus dilakukan pada Direktorat Jenderal Pajak (DJP), Kementerian Keuangan Republik Indonesia. Hasil penelitian dengan menggunakan slippery slope framework dan wawancara menunjukkan bahwa faktor yang menyebabkan rendahnya kepatuhan wajib pajak dalam hal ini voluntary tax compliance disebabkan oleh rendahnya kepercayaan wajib pajak terhadap Direktorat Jenderal Pajak sebagai otoritas pajak. Upaya untuk meningkatkan voluntary tax compliance telah dilakukan Direktorat Jenderal Pajak dengan melakukan penyuluhan dengan pola pembinaan usaha wajib pajak melalui business development services (BDS). Dalam pelaksanaannya, BDS yang dilaksanakan DJP ternyata belum optimal dalam meningkatkan voluntary tax compliance, hal ini disebabkan oleh kepercayaaan masyarakat atas DJP belum dapat ditingkatkan secara optimal melalui program BDS. Terhadap adanya permasalahan tersebut, penelitian ini menyarankan DJP untuk melakukan pembaharuan dengan mengkombinasikan program BDS dengan strategi marketing yang telah teruji sukses sejak abad 18 SM yaitu AIDA (Attention, Interest, Desire dan Action).Dengan kombinasi BDS dan AIDA social marketing maka setiap tahapan perilaku dari objek BDS mulai dari perhatian/ kesadaran atas adanya Program BDS, ketertarikan atas Implementasi dari program BDS, keinginan untuk mengetahui kewajiban perpajakan karena telah merasa dibantu dalam mengembangkan usahanya, hingga memutuskan untuk melakukan aksi dengan membayar Pajak PP.46 karena adanya rasa percaya terhadap dapat dipantau dengan pendampingan secara berkelanjutan dan terus menerus sehingga BDS dapat berjalan secara optimal dan efektif dalam meningkatkan voluntary tax compliance yang berdampak positif pada penerimaan pajak. Pendahuluan Dalam studi pendahuluan (preliminary study) atas penerapan Peraturan Pemerintah Nomor 46 Tahun 2013 Tentang Pajak Penghasilan Atas Penghasilan Dari Usaha Yang Diterima Atau Diperoleh Wajib Pajak (WP) Yang Memiliki Peredaran Bruto Tertentu (PP 46), penulis mengumpulkan informasi/data awal terkait dengan rencana penelitian melalui wawancara dan pengolahan data awal dengan narasumber dari Direktorat Potensi, Kepatuhan dan Penerimaan, Direktorat Peraturan Perpajakan II dan Direktorat Teknologi dan Informasi Perpajakan pada Kantor Pusat Direktorat Jenderal Pajak. Studi pendahuluan menemukan bahwa PP 46 yang telah diterapkan selama lebih dari tiga tahun ternyata menyebabkan terjadinya potential loss penerimaan pajak penghasilan dari sektor UMKM yang memiliki peredaran bruto tidak melebihi 4.8 Miliar. Potential loss penerimaan perpajakan diartikan sebagai selisih antara realisasi penerimaan pajak dengan potensi penerimaan pajak yang seharusnya dibayarkan oleh WP. Berdasarkan wawancara peneliti dengan narasumber dari Direktorat Potensi, Kepatuhan dan Penerimaan Direktorat Jenderal Pajak, diketahui bahwa terjadi potential loss penerimaan pajak penghasilan final dari sektor UMKM yang cukup besar, hal ini disebabkan tingkat kepatuhan dari WP yang merupakan WP yang termasuk kriteria PP.46 cukup rendah. Dalam Penulisan ini, penulis membagi kategori WP PP.46 menjadi dua bagian yaitu WP kriteria PP.46 dan WP PP.46. WP kriteria PP.46 adalah seluruh WP yang memiliki peredaran bruto tidak lebih dari 4.8 Miliar dalam satu tahun baik yang belum melaksanakan kewajiban perpajakan, yang telah melaksanakan kewajiban perpajakannya berdasarkan PP.46 maupun yang masih melakukan pembayaran berdasarkan Pasal 25/29 Undang – Undang Pajak Penghasilan, jadi WP Kriteria PP.46 adalah jumlah keseluruhan potensi UMKM yang diharapkan dapat melaksanakan kewajiban perpajakan. Sedangkan WP PP.46 adalah WP yang telah melaksanakan kewajiban perpajakannya berdasarkan PP.46. Berdasarkan data UMKM dari Kementerian Koperasi dan UKM, jumlah unit UMKM selama tahun 2013 hingga tahun 2015 rata – rata mengalami peningkatan sebesar 2 % lebih dimana pada tahun 2015 terdapat 59 juta lebih unit UMKM, sedangkan berdasarkan data dari Direktorat PKP DJP, sejak tahun 2013 hingga tahun 2015 persentase kenaikan jumlah WP PP.46 meningkat secara signifikan setiap tahunnya namun masih sangat jauh dari angka potensi jumlah unit UMKM. Bila kita bandingkan data Kemenkop dan UKM dan Data dari Dir. PKP DJP maka dapat kita ketahui pada tahun 2015 terdapat 58 juta lebih UMKM yang merupakan WP Kriteria PP.46 belum melaksanakan kewajiban perpajakannya yang berdampak pada potential loss penerimaan pajak dari sektor UMKM. Terjadinya potensial loss penerimaan pajak dipengaruhi oleh rendahnya kepatuhan WP dalam memenuhi kewajiban perpajakannya untuk menghitung, membayar dan melaporkan kewajiban pajaknya. Apabila WP patuh dalam melakukan self assessment untuk menghitung kewajiban perpajakannya dengan jujur, serta membayar dan melaporkan pajaknya dengan benar maka potential loss penerimaan pajak dapat dihindari. Kepatuhan WP dalam memenuhi kewajiban perpajakannya dapat dikaji melalui teori Slipperry Slope Framework (Kirchler, Hoelzl, & Wahl, 2008). Kepatuhan atas kewajiban perpajakan dalam teori ini dibagi menjadi dua, yaitu kepatuhan yang timbul karena adanya unsur pemaksaan (Enforced Tax Compliance) dan kepatuhan yang muncul karena kesadaran sendiri WP (Voluntary Tax Compliance). Enforced Tax Compliance muncul karena adanya tindakan pemaksaan oleh penguasa sebagai pemegang power of authority. Semakin sering pemeriksaan dilakukan, semakin sering penagihan dilakukan, semakin sering penuntutan dilakukan, WP makin patuh. Jika nekad tidak patuh, mereka akan dihukum. Semakin besar kekuasaan petugas pajak dan semakin sering mereka menggunakan kekuasaannya itu, tingkat kepatuhan WP juga akan naik. Sedangkan Voluntary Tax Compliance timbul karena kepercayaan WP terhadap pemerintah sehingga masyarakat akan memenuhi kewajiban perpajakannya dengan sukarela tanpa adanya paksaan. Seperti pendapat Eberl (2003) bahwa kepercayaan digambarkan sebagai kualitas khusus dari suatu hubungan, yaitu, mitra dalam berinteraksi dan berbagi aspek positif serta adanya motivasi untuk mempertahankan hubungan (Kirchler, Hoelzl, & Wahl, 2008). Turunnya kepercayaan WP atas PP 46 mengakibatkan turunnya voluntary tax compliace dan bila tidak diimbangi dengan tingginya enforced tax compliance maka WP akan cenderung menghindar untuk memenuhi kewajiban perpajakannya demi meningkatkan keuntungan sehingga terjadi potential loss penerimaan perpajakan. Dalam upaya untuk meningkatkan voluntary tax compliance WP. Kriteria PP.46, DJP telah melakukan penyuluhan sejak awal diberlakukannya PP.46 pada bulan juli 2013 melalui Surat Direktur Penyuluhan, Pelayanan dan Hubungan Masyarakat (P2Humas) Nomor S-1046/PJ.09/2013 Tanggal 12 Juli 2013 perihal Sosialisasi Peraturan Pemerintah Nomor 46 Tahun 2013 dilanjutkan dengan melakukan uji coba program Bussines Development Services (BDS) pada delapan Kanwil DJP pada tahun 2015. BDS adalah kegiatan pelatihan dan pembinaan terhadap para pelaku UKM dengan memberikan materi yang berisi cara-cara yang mendorong perkembangan usaha para pelaku UKM dan materi terkait perpajakan untuk meningkatkan kepatuhan perpajakan. Pada bulan oktober 2016, sebagai tindak lanjut dari uji coba pelaksanaan program BDS dan dalam rangka implementasi Inisiatif 2 Program Transformasi Kelembagaan yaitu Menjangkau Ekonomi Informal melalui Pendekatan End to End dan meningkatkan kepatuhan WP UKM, program Business Development Services (BDS) dilaksanakan secara Nasional, yang disampaikan melalui Surat Direktur Jenderal Pajak Nomor S- 284/PJ.13/2016 Tanggal 31 Oktober 2016 perihal Pelaksanaan Pembinaan WP UKM melalui Program Business Development Services (BDS). Dalam pelaksanaannya, berdasarkan data pertumbuhan jumlah WP yang menjadi patuh untuk melaksanakan kewajiban perpajakan berdasarkan PP.46, pembinaan melalui program BDS yang dilaksanakan DJP menunjukkan adanya peningkatan jumlah WP.PP 46. Namun hasil tersebut belum optimal bila dibandingkan dengan jumlah UMKM yang terdata oleh Kemenkop UKM. Program BDS yang dilaksanakan DJP baru dalam tahap membuat WP memberikan perhatian (attention) kepada program BDS serta tertarik untuk mengikuti (interest), namun belum sampai pada menyentuh aspek kepercayaan WP terhadap DJP sehingga WP berkeinginan untuk mengetahui kewajiban perpajakannya serta berujung pada tindakan (action) untuk membayar pajak. Penulis akan melakukan analisis faktor yang mempengaruhi rendahnya voluntary tax compliance WP Kriteria PP.46 yang berdampak pada potential loss penerimaan pajak melalui data serta wawancara dari instansi terkait, WP UMKM dan pengamat perpajakan. Penulis juga akan berupaya memberikan rekomendasi solusi dalam upaya meningkatkan voluntary tax compliance WP Kriteria UMKM melalui optimalisasi program BDS yang relevan untuk meningkatkan voluntary tax compliance sehingga potensi penerimaan pajak dari sektor UMKM dapat dipungut atau dapat terrealisasi secara maksimal. Berdasarkan hal tersebut, penelitian ini mengajukan pertanyaan-pertanyaan sebagai berikut: Apakah faktor yang menyebabkan voluntary tax compliance atas penerapan Peraturan Pemerintah Nomor 46 Tahun 2013? Bagaimana upaya yang relevan untuk meningkatkan voluntary tax compliance sehingga penerapan Peraturan Pemerintah Nomor 46 Tahun 2013 dapat optimal? Tinjauan Teoritis Prof. Dr. P.J.A. Adriani seperti dikutip oleh Tobias (1985) mendefinisikan pajak sebagai iuran yang diberikan masyarakat kepada negara (dapat dipaksakan) yang terutang berdasarkan peraturan-peraturan, dengan tidak mendapatkan prestasi kembali secara langsung, dan digunakan untuk membiayai pengeluaran-pengeluaran umum yang berhubungan dengan tugas negara untuk menyelenggarakan pemerintahan. Pajak merupakan peralihan kekayaan dari rakyat kepada negara guna membiayai pengeluaran-pengeluaran rutin negara dan surplusnya akan dipergunakan untuk public saving yang merupakan sumber utama membiyai public investment, dalam definisi ini, titik penekanannya terletak pada fungsi budgetair dari pajak. Dalam penyelenggaraan administrasi perpajakan terdapat dasar-dasar bagi terselenggaranya administrasi perpajakan yang baik meliputi (Mansury, 2002): 1. Kejelasan dan kesederhanaan dari ketentuan undang-undang yang memberi kejelasan bagi WP serta memudahkan secara administrasi. 2. Kesederhanaan akan mengurangi penyelundupan pajak. Kesederhanaan yang dimaksud baik dalam kesederhanaan untuk dilaksanakan oleh aparat pajak, serta kesederhanaan perumusan yuridis yang memberi kemudahan untuk dipahami dan dipatuhi oleh WP dalam memenuhi kewajiban perpajakannya. Tarif pajak terdiri dari beberapa jenis, menurut Soemitro (1986) terdapat empat jenis tarif, yang pertama, tarif tetap yang besarnya tetap atau tidak berubah, meskipun jumlah yang dijadikan dasar perhitungan berubah. Jadi tidak tergantung kepada nilai objek yang dikenakan pajak. kedua, tarif proporsional yang berupa suatu persentase tetap yang tidak berubah-ubah, tetapi jika jumlah yang dijadikan dasar perhitungan berubah, maka jumlah uang yang harus dibayar berubah juga. Ketiga tarif progresif yang persentase pemungutannya semakin naik apabila jumlah yang dijadikan dasar perhitungan semakin besar. Dan keempat tarif degresif yang persentasenya semakin menurun apabila jumlah yang dijadikan dasar perhitungan semakin besar. Selain keempat tarif tersebut terdapat satu tarif lainnya yaitu tarif final. Pajak penghasilan dengan tarif final dikenakan terhadap semua jumlah penghasilan yang diperoleh dalam satu tahun berdasarkan tarif pajak. Slippery Slope Framework Kepatuhan WP atas kewajiban perpajakan dalam dapat dikaji melalui teori Slipperry Slope Framework (Kirchler, Hoelzl, & Wahl, 2008). Kepatuhan atas kewajiban perpajakan dalam teori ini dibagi menjadi dua, yaitu kepatuhan yang karena adanya unsur paksaan (Enforced Tax Compliance) dan kepatuhan yang karena adanya kesadaran WP sendiri (Voluntary Tax Compliance). Enforced Tax Compliance muncul karena adanya paksaan oleh penguasa sebagai otoritas pemegang kekuasaan, semakin sering pemeriksaan dilakukan, maka penagihan akan semakin sering dilakukan, semakin sering penuntutan dilakukan, WP akan semakin patuh. Jika WP nekat untuk tidak patuh, maka mereka akan dihukum. Semakin besar kekuasaan yang dimiliki petugas pajak dan semakin sering kekuasaan itu digunakan, maka tingkat kepatuhan WP akan meningkat. Sedangkan Voluntary Tax Compliance timbul karena kepercayaan WP terhadap pemerintah sehingga masyarakat akan memenuhi kewajiban perpajakannya dengan sukarela tanpa adanya paksaan. Kepercayaan digambarkan sebagai kualitas khusus dari suatu hubungan, yaitu, mitra dalam berinteraksi dan berbagi aspek positif serta adanya motivasi untuk mempertahankan hubungan (Kirchler, Hoelzl, & Wahl, 2008). Salah satu dimensi dari kepercayaan dalam slippery slope framework adalah trushworthiness dan fairness, trushworthiness adalah pertimbangan untung-rugi dimasa yang akan datang ketika WP akan patuh terhadap aturan perpajakan,dalam hal ini, WP yang mengalami kerugian/kemungkinan kerugian akan memiliki trushworhiness yang rendah. Fairness adalah kondisi di mana WP akan menjadi patuh apabila pemerintah berlaku secara adil (Tan dan Liu,2016). Business Development Services BDS didefinisikan sebagai layanan non-keuangan yang diberikan kepada UKM dengan dukungan oleh donor yang pada berbagai tahap perkembangan termasuk pada fase star-up (belum memulai) (ILO, 2007). Layanan ini bisa meliputi, misalnya pelatihan, konseling dan saran, penyediaan informasi, pengembangan teknologi dan transfer dan hubungan bisnis. BDS ditujukan untuk membantu UKM mengatasi kendala internal dan eksternal dalam pembangunan mereka dan dengan demikian memperbaiki kinerjanya. Di negara berkembang, usaha mikro dan keci (UMK) memiliki porsi yang signifikan dalam jumlah total angkatan kerja sehingga dukungan untuk pengembangan bisnis UMK baik formal maupun informal dapat memberikan tingkat keuntungan, upah, serta lapangan kerja yang lebih tinggi dan dapat berkontribusi dalam transisi keluarnya pengusaha dan pekerja dari kemiskinan (Sievers, Vandenberg, 2007). Lebih lanjut, menurut Sievers dan Vendenberg salah satu cara penguatan UMK menurut adalah dengan memperbaiki akses mereka terhadap layanan pendukung utama bagi perusahaan yang bisa dibagi menjadi dua dasar Kategori: (1) jasa keuangan, terutama kredit mikro dan (2) pengembangan layanan usaha atau Business Development Program (BDS). BDS terdiri dari berbagai layanan non finansial yang meningkatkan daya saing perusahaan melalui produktivitas yang lebih tinggi, desain produk yang lebih baik, penyampaian layanan yang lebih baik, dan / atau peningkatan akses pasar. Pelaksanaan BDS dapat dikombinasikan dengan menerapkan teori pemasaran yang ditemukan oleh E. St. Elmo Lewis pada tahun 1898, yaitu Atenttion, Interest, Desire and Action (AIDA). Model AIDA berisi formula yang terdiri dari empat langkah untuk mendapatkan perhatian, menarik minat, menciptakan keinginan, lalu mengambil tindakan. Menurut pendapat Kojima (2010) dalam (Hasan, Nadzim, Shiratuddin, 2015) AIDA sangat berguna dalam menilai dampak iklan dengan mengendalikan setiap proses transformasi psikologis yang dimulai dari tingkat individu untuk melihat dampak iklan sampai dengan pembelian yang dilakukan Individu yang bersangkutan. Tujuan dari suatu kegiatan pemasaran berujung pada kesediaan konsumen untuk membeli produk, memanfaatkan jasa, atau mengikuti keinginan marketer. Kotler dalam Khusnaini (2016) merumuskan ada tahapan yang harus dilalui sebelum konsumen memutuskan untuk merubah perilaku. Tahapan tersebut secara berurutan meliputi: 1. Tahap menaruh perhatian (attention), merupakan tahapan dimana marketer berusaha agar konsumen sadar dan tahu akan keberadaan produk yang dipasarkan atau suatu kebijakan/progam yang dikampanyekan. Upaya yang dilakukan pada tahap ini bisa berupa promosi, iklan atau kampanye di media cetak, media online, radio atau televisi. 2. Tahap ketertarikan (interest), setelah konsumen mengetahui keberadaan produk, tahapan ini mengupayakan agar konsumen merasa setuju, senang atau tertarik tentang produk atau jasa yang ditawarkan, serta progam yang dikampanyekan. Upaya yang dilakukan antara lain memberikan informasi lebih jauh tentang produk, menyampaikan keuntungan-keuntungan bila memiliki produk tersebut, melakukan suatu kegiatan/progam/kebijakan yang disampaikan. 3. Tahap berniat (desire), ini adalah tahapan melakukan penawaran atau kegiatan yang tujuannya konsumen menjadi sangat yakin tertarik untuk memiliki, memanfaatkan produk tersebut, atau melakukan suatu progam atau kebijakan. 4. Tahap memutuskan untuk membeli atau mengubah perilaku (action), puncaknya adalah konsumen bersedia melakukan aktivitas dalam rangka pembelian produk, memanfaatkan jasa, atau mematuhi sebuah kebijakan. Dengan pengadopsian AIDA dalam penerapan BDS maka setiap tahapan prilaku dari objek BDS mulai dari perhatian/kesadaran atas adanya produk, ketertatikan atas produk, keinginan untuk memiliki produk hingga memutuskan untuk melakukan aksi dengan membeli produk dapat terus dipantau, sehingga pelaksanaan BDS dapat berjalan efektif dan tujuan pelaksanaannya dapat tercapai. Metode Penelitian Penelitian ini menggunakan metode penelitian kualitatif. Penelitian kualitatif merupakan suatu pendekatan untuk menyelidiki dan memahami makna masalah sosial dari individu maupun kelompok manusia (Creswell, 2014). Selanjutnya penelitian ini menggunakan pendekatan studi kasus. Thomas (2011) menyatakan bahwa studi kasus dilakukan secara mendalam terhadap suatu hal (orang, kelompok, lembaga atau peristiwa), mempelajarinya secara rinci, serta tidak bertujuan untuk menggeneralisasikan hal tersebut (Thomas dan Taylor, 2015). Teknik pengumpulan data dalam penelitian ini adalah triangulasi sumber data yang meliputi teknik observasi, wawancara, dan analisis dokumen. Maksud dari penggunaan ketiga teknik tersebut adalah untuk memperoleh informasi yang dapat saling melengkapi dalam rangka mendapatkan pemahaman yang utuh terkait dengan topik penelitian. Wawancara dalam penelitian ini dilakukan dengan: Peneliti Utama pada Kementerian Koperasi dan Usaha Kecil dan Menengah; Kepala Sub-bidang PPh Umum Badan Kebijakan Fiskal; Kepala Seksi Pemutakhiran Data Tampilan Direktorat Teknologi Informasi Perpajakan, DJP; Kepala Subdit Dampak Kebijakan Direktorat Potensi, Kepatuhan dan Penerimaan, DJP; Kepala Seksi Dampak Kebijakan Makro, Dit.PKP DJP. Widyaiswara Pusat Pendidikan dan Pelatihan (Pusdiklat) Pajak; Pengamat Perpajakan yang merupakan Direktur Centre of Indonesia Tax Analysis; dan Empat pelaku usaha UMKM Narasumber wawancara tersebut dipilih berdasarkan teknik purposive sampling dengan kriteria meliputi terlibat langsung dalam permasalahan penelitian, menguasai permasalahan, memiliki informasi dan/atau data, serta bersedia memberikan informasi yang lengkap dan akurat. Pemilihan narasumber juga mempertimbangkan potensi kemiripan dan keberulangan informasi yang akan disampaikan oleh pihak-pihak yang terlibat serta adanya keterbatasan waktu dan biaya. Jenis wawancara yang digunakan dalam penelitian ini adalah wawancara semi terstruktur. Wawancara semi terstruktur digunakan karena lebih memberikan keleluasaan kepada narasumber dalam menjawab pertanyaan serta memberikan kesempatan kepada pewawancara untuk menggali jawaban dari narasumber (Edwards dan Holland, 2013). Penelitian ini mengambil studi kasus di Direktorat Jenderal Pajak, Kementerian Keuangan Republik Indonesia sebagai otoritas yang mengadministrasikan pajak, dalam penelitian ini khususnya pada penerapan Peraturan Pemerintah Nomor 46 Tahun 2013. Pelaksanaan Penyuluhan atas penerapan PP.46 merupakan lingkup tugas dari Direktorat Ekstensifikasi dan Penilaian bersama dengan Direktorat Penyuluhan, Pelayanan dan Hubungan Masyarakat. Sedangkan kajian mengenai dampak penerapan PP.46 terhadap kepatuhan wajib pajak serta potensi penerimaan merupakan lingkup tugas dari Direktorat Potensi, Kepatuhan dan Penerimaan Pajak. Research Finding and Discussion Analisis penelitian dimulai dengan melakukan analisis atas rendahnya kepatuhan dari WP kriteria PP.46 Tahun 2013 yang berdampak pada potential loss penerimaan pajak. melalui analisis melalui penyandingan data UMKM dari Kementerian Koperasi dan UKM dan Data jumlah wajib pajak serta jumlah penerimaan pajak PP.46 dari Direktorat Teknologi Informasi Perpajakan (TIP) dan Direktorat Potensi, Kepatuhan dan Penerimaan (PKP) Direktorat Jenderal Pajak. Data UMKM terdiri dari: 1. Data jumlah UMKM secara nasional, 2. Data jumlah koperasi secara nasional, 3. Data peran UMKM terhadap investasi, 4. Data peran UMKM terhadap PDB ,serta 5. Data pertumbuhan unit usaha dan tenaga kerja UMKM. Keseluruhan data diperoleh melalui surat permohonan resmi dari Magister Akuntansi Universitas Indonesia. Analisis Rendahnya Kepatuhan Dari WP Kriteria PP.46 Tahun 2013 Yang Berdampak Pada Potential Loss Penerimaan Pajak. Berdasarkan persandingan data jumlah WP PP.46 dan UMKM, jumlah unit UMKM selama tahun 2013 hingga tahun 2015 rata – rata mengalami peningkatan sebesar 2 % lebih dimana pada tahun 2015 terdapat 59 juta lebih unit UMKM. Sedangkan berdasarkan data dari Direktorat PKP DJP, sejak tahun 2013 hingga tahun 2015 persentase kenaikan jumlah WP PP.46 meningkat secara signifikan setiap tahunnya namun masih sangat jauh dari angka potensi jumlah unit UMKM. Bila kita bandingkan data Kemenkop dan UKM dan Data dari Dir. PKP DJP maka dapat kita ketahui pada tahun 2015 terdapat 58 juta lebih UMKM yang merupakan WP Kriteria PP.46 namun belum melaksanakan kewajiban perpajakannya. Pertumbuhan jumlah WP PP.46 dan jumlah penerimaan negara dari PP.46 dalam empat tahun terakhir ternyata belum mencerminkan ter-realisasinya potensi kepatuhan dan penerimaan pajak dari sektor UMKM, hal ini terlihat dari penerimaan pajak yang disetorkan ke kas negara sebesar 3,57 Triliun rupiah lebih pada tahun 2015 sebagai hasil dari penerapan PP.46 hanya berasal dari partisipasi 780.608 WP yang telah patuh (WP PP.46), atau hanya sebesar 1,33% dari keseluruhan WP Kriteria PP.46 yang terdata pada Kemenkop dan UKM pada tahun 2015 yaitu sejumlah 58,5 juta lebih. Sedangkan pada tahun 2016, dengan asumsi jumlah WP Kriteria PP.46 pada tahun 2016 minimal sama dengan jumlah pada tahun 2015 (data jumlah UMKM 2016 dari Kemenkop dan UKM belum tersedia), maka persentase jumlah WP PP.46 hanya sebesar 1,78 % dari dari jumlah WP Kriteria PP.46 dengan jumlah penerimaan pajak PP.46 sebesar 4,3 Triliun. Rendahnya persentase jumlah WP PP.46 menunjukkan bahwa tingkat kepatuhan dari WP Kriteria PP.46 atas penerapan Peraturan Pemerintah Nomor 46 Tahun 2013 sangatlah rendah. Besaran 4,3 Triliun rupiah lebih pada tahun 2016 yang disetorkan ke kas negara sebagai hasil dari penerapan PP.46 didapatkan dari partisipasi 1.046.482 WP PP.46 (Lampiran II), atau hanya sebesar 1,78 % dari WP Kriteria PP.46 dengan asumsi jumlah UMKM pada tahun 2016 sama dengan jumlah UMKM pada tahun 2015 yang berjumlah 58 juta lebih. Potensi kepatuhan dan penerimaan WP Kriteria PP.46 seyogyanya dapat terrealisasi secara optimal dengan meningkatnya jumlah WP kriteria PP.46 menjadi WP PP.46 sehingga berdampak pada jumlah penerimaan pajak yang semakin besar sehingga dapat mendukung pencapaian target penerimaan pajak. Berdasarkan analisa data diatas maka dapat disimpulkan bahwa realisasi penerimaan dari potensi penerimaan negara dari pajak atas penerapan PP.46 masih sangat jauh dari nilai yang seharusnya hal inilah yang dimaksudkan penulis sebagai potential loss penerimaan pajak. Setelah melakukan analisis data, penulis melakukan analisis atas rendahnya kepatuhan dari WP kriteria PP.46 Tahun 2013 yang berdampak pada potential loss penerimaan pajak, penulis melanjutkan penelitian dengan menganalisis faktor penyebab rendahnya kepatuhan WP UMKM atas PP.46 Tahun 2013 yang berdampak pada potential loss penerimaan pajak melalui penggunaan Slippery Slope Framework yang dikuatkan dengan wawancara kepada narasumber terkait. Analisis Faktor Penyebab Rendahnya Kepatuhan WP UMKM atas PP.46 Tahun 2013 yang berdampak pada Potential Loss Penerimaan Pajak Kepatuhan WP atas kewajiban perpajakan dalam dapat dikaji melalui teori Slipperry Slope Framework (Kirchler, Hoelzl, & Wahl, 2008). Kepatuhan atas kewajiban perpajakan dalam teori ini dibagi menjadi dua, yaitu kepatuhan yang karena adanya unsur paksaan (Enforced Tax Compliance) dan kepatuhan yang karena adanya kesadaran WP sendiri (Voluntary Tax Compliance). Enforced Tax Compliance muncul karena adanya paksaan oleh penguasa sebagai otoritas pemegang kekuasaan, semakin sering pemeriksaan dilakukan, maka penagihan akan semakin sering dilakukan, semakin sering penuntutan dilakukan, WP akan semakin patuh. Kemudahan yang diberikan Pemerintah kepada WP UMKM dalam memenuhi kewajiban perpajakannya tidak terlepas dari tujuan Pemerintah melalui PP 46 yaitu untuk mendorong pertumbuhan dan perkembangan UMKM yang berdampak pada peningkatkan kepatuhan perpajakan secara sukarela (voluntary tax compliance) melalui kebijakan yang berpihak kepada UMKM guna membangun rasa kepercayaan WP kepada Pemerintah, khususnya DJP. Voluntary tax compliance timbul karena kepercayaan WP terhadap pemerintah sehingga masyarakat akan memenuhi kewajiban perpajakannya dengan sukarela tanpa adanya paksaan. Kepercayaan digambarkan sebagai kualitas khusus dari suatu hubungan, yaitu, mitra dalam berinteraksi dan berbagi aspek positif serta adanya motivasi untuk mempertahankan hubungan. Kepercayaan WP terhadap otoritas perpajakan dalam hal ini DJP, merupakan hal yang sangat utama dalam terwujudnya Voluntary Tax Compliance. Dengan adanya rasa percaya dari masyarakat maka akan tercipta hubungan yang baik antara WP dan fiskus dalam bentuk kemitraan yang dapat berbagi aspek positif baik bagi pengembangan usaha WP maupun bagi peningkatan kepatuhan WP. Setelah membahas mengenai enforced tax compliance dan voluntary tax compliance pada penerapan PP.46, dimana tujuan utama dari diterbitkannya PP.46 adalah untuk mencapai voluntary tax compliance melalui pemberian insentif dalam bentuk kemudahan administrasi perpajakan serta tarif pajak yang rendah bagi WP bukanlah melakukan penegakan hukum untuk mencapai enforced tax compliance, hal ini tercermin dari tidak diaturnya sanksi didalam PP.46. Berdasarkan slippery slope framework rendahnya tingkat voluntary tax compliance terjadi karena tingkat kepercayaan WP UMKM terhadap DJP sebagai otoritas perpajakan masih rendah. Upaya Meningkatkan Voluntary Tax Compliance WP Kriteria PP.46 Dalam upaya untuk meningkatkan voluntary tax compliance WP. Kriteria PP.46, DJP telah melakukan penyuluhan sejak awal diberlakukannya PP.46 pada bulan juli 2013 melalui Surat Direktur Penyuluhan, Pelayanan dan Hubungan Masyarakat (P2 Humas) Nomor S-1046/PJ.09/2013 Tanggal 12 Juli 2013 perihal Sosialisasi Peraturan Pemerintah Nomor 46 Tahun 2013 yang ditujukan kepada Kepala Kantor Wilayah (Kanwil), Kepala Kantor Pelayanan Pajak (KPP) dan Kepala Kantor Pelayanan, Penyuluhan, dan Konsultasi Perpajakan (KP2KP) di seluruh Indonesia. Pada Bulan Oktober tahun 2016, sebagai tindak lanjut dari uji coba pelaksanaan program BDS dan dalam rangka implementasi Inisiatif 2 Program Transformasi Kelembagaan yaitu Menjangkau Ekonomi Informal melalui Pendekatan End to End dan meningkatkan kepatuhan WP UKM, program Business Development Services (BDS) dilaksanakan secara Nasional, yang disampaikan melalui Surat Direktur Jenderal Pajak Nomor S- 284/PJ.13/2016 Tanggal 31 Oktober 2016 perihal Pelaksanaan Pembinaan WP UKM melalui Program Business Development Services (BDS) dimana Direktorat Ekstensifikasi dan Penilaian sebagai sponsor dari Inisiatif 2 Program Transformasi Kelembagaan. Dalam surat tersebut, setelah melakukan BDS maka Kantor Pelayanan Pajak (KPP) berkewajiban untuk melakukan monitoring dan membuat laporan monitoring pembinaan WP UMKM melalui BDS yang dilaporkan secara berjenjang melalui Kanwil DJP dalam hal ini Bidang Pendaftaran, Ekstensifikasi dan Penilaian yang akan melakukan rekapitulasi laporan setiap KPP dan selanjutnya dilaporkan ke Direktur Ekstensifikasi dan Penilaian serta Direktur P2Humas. Dalam Laporan Monitoring ini terdapat informasi mengenai: Jumlah peserta seminar pengembangan usaha; Jumlah peserta seminar yang sudah ber-NPWP; Jumlah peserta seminar yang belum ber-NPWP; Tindak lanjut ekstensifikasi melalui pemberian/pendaftaran NPWP; Tindak lanjut intensifikasi melalui mendataan jumlah peserta seminar yang melakukan pembayaran secara rutin, serta Tindak lanjut pelaksanaan kelas pajak. Dalam pelaksanaannya, berdasarkan data pertumbuhan jumlah WP yang menjadi patuh untuk melaksanakan kewajiban perpajakan berdasarkan PP.46, pembinaan melalui program BDS yang dilaksanakan DJP menunjukkan adanya peningkatan jumlah WP.PP 46, namun hasil tersebut belum optimal bila dibandingkan dengan jumlah UMKM yang terdata oleh Kemenkop UKM. Menurut analisis penulis, BDS yang dilaksanakan oleh DJP yang masih belum optimal dalam menyentuh hati dan menumbuhkan kepercayaan WP dikarenakan pola BDS tersebut masih terbatas dalam lingkup formalitas pelaksanaan pelatihan terhadap pelaku UKM dengan memberikan materi yang berisi cara – cara yang mendorong perkembangan usaha para pelaku UKM dan materi terkait perpajakan untuk meningkatkan kepatuhan perpajakan. Hal ini terlihat dari tindak lanjut monitoring pelaksanaan BDS yang telah dijelaskan sebelumnya, yaitu hanya terbatas pada memberikan laporan perihal jumlah peserta seminar yang sudah maupun belum ber-NPWP, tindak lanjut ekstensifikasi melalui pemberian/pendaftaran NPWP, tindak lanjut intensifikasi melalui pendataan jumlah peserta seminar yang melakukan pembayaran secara rutin dan tindak lanjut pelaksanaan kelas pajak sehingga hubungan antara WP dan DJP terbatas pada pendataan semata, belum mencakup pembinaan kedekatan antara pelaku UKM dengan DJP yang diharapkan dapat menimbulkan Kepercayaan WP terhadap DJP. Untuk dapat mencapai tujuan dilaksanakannya BDS oleh DJP maka perlu dilakukan optimalisasi pelaksanaan BDS agar WP menjadi percaya terhadap DJP sebagai otoritas pajak dengan melaksanakan pola pendampingan secara berkelanjutan dan terus menerus sehingga Voluntary Tax Compliance dapat terwujud melalui kesediaan WP untuk membayar pajak secara rutin. Optimalisasi Penerapan PP. 46 Tahun 2013 melalui konsep social marketing AIDA pada program BDS Sebagai bentuk upaya dalam mendorong pertumbuhan UMKM yang telah sukses diterapkan oleh beberapa negara terutama oleh donor (pemberi bantuan kredit), BDS memberikan keuntungan tidak hanya bagi UMKM dalam hal meningkatkan pengetahuan dan keterampilan sehingga meningkatkan keuntungan usaha, BDS juga memberikan keuntungan bagi lembaga kredit (donor) karena kemampuan pengembalian kredit oleh debitur menjadi meningkat sehingga terhindar dari kredit macet dan terutama memberikan keuntungan bagi pemerintah sebagai penyedia BDS karena UKM mengalami pertumbuhan (Sievers & Vandenberg, 2007). Berdasarkan penelitian International Labor Organization (ILO) BDS efektif dalam mendorong perkembangan iklim usaha Small and medium enterprises (ILO,1997). Keberhasilan pelaksanaan BDS pada UMKM juga berperan dalam meningkatkan penerimaan pajak suatu negara. Dengan membuka akses untuk BDS sehingga dikenal luas dan tersedia untuk semua UKM dan mengidentifikasi kebutuhan spesifik UKM untuk mengatasi hambatan di masing – masing UKM diperlukan guna meningkatkan aktivitas UKM serta peran UKM dalam perdagangan internasional dan berdampak pada peningkatan penerimaan pajak sehingga pemerintah dapat meningkatkan infrastruktur serta memberikan dukungan atas pengembangan teknologi (Baily, 2007). Melalui upaya pendekatan Business Development Services (BDS) diharapkan akan terjadi kedekatan pajak (buy-in) antara para pelaku UMKM dengan kantor pajak sehingga kesadaran pajak WP dapat tumbuh bersama dengan bertumbuhnya usaha UMKM. Intinya adalah bagaimana memunculkan motivasi untuk patuh pajak dengan cara DJP menjadi fasilitator terpenuhinya kebutuhan WP sehingga diharapkan dapat tercipta Voluntary Tax Compliance. Namun, Upaya penyuluhan yang telah dilaksanakan oleh DJP, khususnya melalui BDS yang diatur dalam Surat Direktur Ekstensifikasi dan Penilaian nomor S-170/PJ.06/2015 Tanggal 24 April 2015 perihal Uji Coba Pembinaan WP UKM melalui program Bussines Development Services (BDS) dan Surat Direktur Ekstensifikasi dan Penilaian Nomor S- 284/PJ.13/2016 Tanggal 31 Oktober 2016 perihal Pelaksanaan Pembinaan WP UKM melalui Program Business Development Services (BDS) ternyata belum membuahkan hasil yang optimalternyata belum membuahkan hasil yang optimal, hal ini dikarenakan metode dalam penerapan BDS tersebut masih belum menyentuh aspek Kepercayaan WP Kriteria PP.46 sehingga belum optimal meningkatkan voluntary tax compliance. Berbeda dengan metode BDS yang dilakukan oleh DJP, BDS yang direkomendasikan oleh penulis adalah BDS dengan penerapan strategi social marketing yang telah telah diakui keberhasilannya sejak akhir abad 18 hingga saat ini yaitu Attention, Interest, Desire dan Action (AIDA) yang diperkenalkan E. St. Elmo Lewis pada tahun 1898, dimana dengan strategi ini maka pelaksanaan BDS dapat terlaksana secara berkelanjutan dan terus-menerus sehingga timbul rasa percaya dalam diri wajib pajak karena peran DJP dalam pengembangan usaha mereka. Pelaksanaan BDS yang dikombinasikan dengan social marketing Atenttion, Interest, Desire and Action (AIDA) diharapkan mampu untuk menghasilkan keempat proses diatas.. Model AIDA berisi formula yang terdiri dari empat langkah untuk mendapatkan perhatian, menarik minat, menciptakan keinginan, lalu mengambil tindakan. Menurut pendapat Kojima (2010) dalam (Hasan, Nadzim, Shiratuddin, 2015) AIDA sangat berguna dalam menilai dampak iklan dengan mengendalikan setiap proses transformasi psikologis yang dimulai dari tingkat individu untuk melihat dampak iklan sampai dengan pembelian yang dilakukan Individu yang bersangkutan. Penerapan strategi social marketing AIDA pada BDS yang ditujukan untuk mengubah perilaku WP kriteria PP.46 agar menjadi patuh diimplementasikan melalui empat tahapan AIDA: 1. Pada tahap awareness, target audience yang merupakan WP OP pelaku UMKM diharapkan tahu dan memberikan perhatian terhadap program BDS yang dibentuk oleh KPP, Upaya yang dilakukan untuk menarik perhatian WP UMKM adalah membentuk grup komunitas via media sosial serta mengirimkan SMS Blast (Massal) tentang program BDS yang ditawarkan. Dalam tahapan ini diusahakan untuk tidak membahas pajak secara khusus namun lebih mengutamakan pemberian informasi perihal keuntungan yang diperoleh WP bila mengikuti program BDS DJP. 2. Tahap Interest, WP diharapkan mulai tertarik untuk menghikuti program BDS yang dilaksanakan oleh KPP melalui pelatihan – pelatihan, gathering WP UMKM serta berbagai upaya lain yang ditujukan untuk mendorong kemajuan usaha dari WP.. Pada tahap ini DJP mulai untuk memberikan informasi – informasi ringan mengenai PP.46 3.Tahapan desire, setelah memberikan pelatihan-pelatihan BDS, KPP: a)membentuk grup dalam media sosial misalnya grup Whats-app atau sejenisnya sebagai sarana untuk berbagi tips dan trik terkait kewirausahaan antar WP dan dimana KPP menjadi Admin dari grup tersebut. Media ini dapat pula menjadi wadah bagi sesama WP UMKM untuk saling membantu satu dengan yang lainnya dalam mempromosikan produk mereka. b) melibatkan tokoh UMKM untuk menjadi “duta pajak”sebagai perpanjangan tangan dari KPP untuk dapat memperluas jaringan KPP sehingga dapat menjangkau WP UMKM lebih banyak lagi. c) mengadakan acara gathering UMKM atau progam kunjungan ke lokasi para pelaku UMKM, kegiatan ini ditujukan untuk membina kedekatan antara WP dan petugas KPP sekaligus untuk melakukan evaluasi maupun perencanaan program BDS berikutnya. Pada tahapan ini, diharapkan WP mulai merasakan bahwa DJP ingin berpartisipasi dalam mendorong perkembangan usaha WP agar dapat maju dan berkembang, sehingga timbullah rasa percaya WP terhadap DJP karena DJP peduli atas usaha mereka dan timbullah kedekatan antara WP dan DJP. Dalam tahap ini DJP mulai fokus untuk memberikan bimbingan perpajakan agar WP mengetahui kewajiban apa saja yang perlu dilakukannya. 4.Tahapan action, pada tahapan ini dilakukan upaya terhadap target responden yang sudah mendukung program BDS DJP dan telah mendapatkan manfaat dari program BDS dan telah percaya kepada DJP untuk melaksanakan kewajiban perpajakannya. Tujuannya di tahap ini adalah responden melakukan upaya nyata (action) ke arah voluntary tax compliance, yaitu dengan mendaftarkan diri untuk mendapatkan NPWP atau mulai melakukan pencatatan omset secara lebih teratur dan pada akhirnya melakukan aksi untuk membayar PP.46. Kesimpulan Berdasarkan analisis atas penyandingan data perkembangan UMKM dan Usaha Besar tahun 2010 sampai dengan 2015 (Lampiran I), data rekapitulasi Koperasi Tingkat Nasional Tahun 2017 (Kementerian Koperasi dan UKM Dan Badan Pusat Statistik) serta data jumlah wajib pajak dan penerimaan pajak PP.46 Tahun 2013 sampai dengan Tahun 2016 (Lampiran II), diketahui bahwa tingkat kepatuhan dari WP Kriteria PP.46 (UMKM dengan omzet ≤ 4,8 Miliar) masih sangat rendah sehingga potensi penerimaan negara yang seharusnya dapat diperoleh oleh DJP tidak ter-realisasi secara maksimal. Rendahnya tingkat kepatuhan WP Kriteria PP.46 tercermin dari penerimaan pajak yang disetorkan ke kas negara sebesar 3,57 Triliun rupiah lebih pada tahun 2015 sebagai hasil dari penerapan PP.46 hanya berasal dari partisipasi 780.608 WP yang telah patuh (WP PP.46), atau hanya sebesar 1,33% dari keseluruhan WP Kriteria PP.46 yang terdata pada Kemenkop dan UKM pada tahun 2015 yaitu sejumlah 58,5 juta lebih. Rendahnya persentase jumlah WP PP.46 menunjukkan bahwa tingkat kepatuhan dari WP Kriteria PP.46 atas penerapan Peraturan Pemerintah Nomor 46 Tahun 2013 sangatlah rendah yang berdampak pada tidak ter- realisasikannya seluruh potensi penerimaan pajak dari WP Kriteria PP hal inilah yang dimaksudkan penulis sebagai potential loss penerimaan pajak. Upaya pemerintah untuk mendorong pertumbuhan UMKM melalui kebijakan yang berpihak kepada UMKM dengan memberi kemudahan bagi WP UMKM dalam memenuhi kewajiban perpajakannya melalui penerapan PP.46 yang sekaligus bertujuan meningkatkan kepatuhan perpajakan secara sukarela (voluntary tax compliance) ternyata belum memberikan hasil yang baik, hal ini tercermin dari tingkat kepatuhan WP Kriteria PP.46 yang sangat rendah. Berdasarkan slippery slope framework, faktor yang menyebabkan rendahnya tingkat voluntary tax compliance adalah tingkat kepercayaan WP UMKM terhadap DJP sebagai otoritas perpajakan masih rendah sehingga untuk dapat meningkatkan voluntary tax compliance, maka DJP sebagai otoritas pajak harus berupaya untuk meningkatkan kepercayaan wajib pajak. Upaya untuk meningkatkan voluntary tax compliance atas penerapan PP.46 yang telah dilakukan DJP melalui penyuluhan perpajakan, khususnya melalui BDS yang diatur dalam Surat Direktur Ekstensifikasi dan Penilaian nomor S-170/PJ.06/2015 Tanggal 24 April 2015 perihal Uji Coba Pembinaan WP UKM melalui program Bussines Development Services (BDS) dan Surat Direktur Ekstensifikasi dan Penilaian Nomor S- 284/PJ.13/2016 Tanggal 31 Oktober 2016 perihal Pelaksanaan Pembinaan WP UKM melalui Program Business Development Services (BDS) ternyata belum membuahkan hasil yang optimal, hal ini dikarenakan metode dalam penerapan BDS tersebut masih belum menyentuh aspek kepercayaan dari WP Kriteria PP.46 sehingga belum optimal meningkatkan voluntary tax compliance. Untuk mengoptimalkan peningkatan voluntary tax compliance maka penerapan BDS dikombinasikan dengan strategi social marketing yang telah telah diakui keberhasilannya sejak akhir abad 18 hingga saat ini yaitu metode Attention, Interest, Desire dan Action (AIDA) yang diperkenalkan E. St. Elmo Lewis pada tahun 1898. Penerapan strategi social marketing AIDA pada BDS yang ditujukan untuk mengubah perilaku WP kriteria PP.46 agar menjadi patuh diimplementasikan melalui empat tahapan AIDA Saran kepada Direktorat Jenderal Pajak Untuk dapat mengatasi potential loss penerimaan pajak pada penerapan PP.46 Tahun 2013, maka Direktorat Jenderal Pajak sebagai otoritas pajak di Indonesia harus dapat meningkatkan kepercayaan Wajib Pajak Kriteria PP.46 sehingga tercipta peningkatan voluntary tax compliance yang berdampak pada peningkatan realisasi penerimaan pajak atas potensi penerimaan pajak pada WP Kriteria PP.46. Demi optimalnya penerapan PP.46 Tahun 2013 maka upaya Direktorat Jenderal Pajak dalam meningkatkan voluntary tax compliance melalui penerapan business development services (BDS) yang telah diterapkan perlu untuk diperbaharui melalui penerapan strategi AIDA social marketing. Dengan strategi AIDA maka maka setiap tahapan prilaku dari WP mulai dari perhatian/kesadaran atas adanya program BDS, ketertarikan atas Implementasi dari program BDS, keinginan untuk mengetahui kewajiban perpajakan karena telah merasa terbantu dalam mengembangkan usahanya, hingga memutuskan untuk melakukan aksi dengan membayar Pajak karena adanya rasa percaya terhadap DJP dapat terus dipantau, sehingga pelaksanaan BDS dapat berjalan efektif dan tujuan pelaksanaannya dapat tercapai. Translation - English OPTIMIZING THE APPLICATION OF GOVERNMENT REGULATION NUMBER 46 YEAR 2013 IN THE FRAMEWORK OF RESOLVE THE LOW OF TAX COMPLIANCE WHICH IMPACTS ON THE POTENTIAL LOSS OF TAX REVENUE (A CASE STUDY AT THE DIRECTORATE GENERAL OF TAXATION) Raymond Firman Siahaan* and Basri Musri Department of Accounting, Faculty of Economics and Business, University of Indonesia, Central Jakarta 10430, Indonesia *E-mail : [email protected] Abstracts This study aims to propose some steps to optimize the application of Government Regulation No. 46 of 2013 in order to resolve the potential loss of tax revenue by analyzing some factors that lead to the low tax obedience of Micro and Small Medium Enterprises (MSME) taxpayers and propose the relevant efforts to improve taxpayer compliance with its tax obligations. The research method used is the qualitative method with a case study approach. The case study was conducted at the Directorate General of Taxation (DGT), Ministry of Finance of the Republic of Indonesia. The results of research using the slippery slope framework and interviews show that the factors that lead to the low compliance of taxpayers in this case of the voluntary tax compliance caused by the low trust of taxpayers against the Directorate General of Taxation as the tax authority. Some efforts to increase the voluntary tax compliance have been made by the Directorate General of Taxation by doing counseling with the pattern of taxpayer business development through the Business Development Services (BDS). In implementation, the BDS program implemented by the DGT was not optimal in increasing the voluntary tax compliance, this is due to the public confidence on the DGT can not be optimally upgraded through the BDS program. Against these problems, this study suggests DGT to renew by combining the BDS program with a successful marketing strategy since the 18th century BC that is AIDA (Attention, Interest, Desire and Action). With a combination of the BDS program and AIDA social marketing, then each stage of the behavior of the BDS object ranging from the attention/awareness of the BDS Program, interest in the implementation of the BDS program, the desire to know the obligations of taxation because it has felt assisted in developing its business, until deciding to take action by paying tax based on the Government Regulation (GR) No. 46 of 2013 because of the trust on the DGT can be monitored with the ongoing assistance and continuously so that BDS program can run optimally and effectively in increasing the voluntary tax compliance that have a positive impact on tax revenue. Introduction In a preliminary study on the application of Government Regulation No. 46 of 2013 about Income Tax on Income from Business Received Or Obtained by Taxpayer Who Own Certain Gross Distributions (GR 46), the authors collect some information/preliminary data related to the research plan through interviews and preliminary data processing with resource persons from Directorate of Potential, Compliance and Admission, Directorate of Taxation Regulation II and the Directorate of Technology and Taxation Information at the Head Office of the Directorate General of Taxation. The preliminary study found that GR 46 has been applied for more than three years it turned out to cause the potential loss of the income tax revenue from the MSME sector which has a gross revenue not exceeding 4.8 Billion. The potential loss of tax revenue is defined as the difference between tax revenue realization with the potential tax revenue that should be paid by the taxpayer. Based on the researchers interviews with some resource persons from the Directorate of Potential, Compliance and Acceptance of the Directorate General of Taxation, it is known that there is an enough big potential loss of the final income tax revenue from the MSME sector, this is due to the compliance level of the taxpayer which is the taxpayer includes of GR 46 criteria is quite low. In this thesis, the authors divide the categories of taxpayer GR 46 into two parts namely the taxpayer criteria of GR 46 and the taxpayer of GR 46. The taxpayer criteria of GR 46 is all taxpayers which have a gross circulation of not more than 4.8 Billion in one year who have not fulfilled the obligation of taxation, who have carried out their tax obligations under GR 46, as well as those still making payments under Article 25/29 of the Income Tax Act. So, the taxpayer criteria of GR 46 is the total amount of MSME potential that is expected to perform the taxation obligation. While the taxpayer of GR 46 is the taxpayer who has performed its tax obligations based on GR 46. Based on the MSME data from the Ministry of Cooperatives and SMEs, the number of MSME units during 2013 to 2015 averaged an increase of 2% more which in 2015 there are 59 million more units of MSME. While based on data from the Directorate of Potential, Compliance and Acceptance of the Directorate General of Taxes (the Directorate of PCA DGT), from 2013 to 2015 the percentage increase in the number of taxpayer of GR 46 increases significantly every year but still very far from the potential number of units of MSME. When we compare data from the Ministry of Cooperatives and SMEs and Data from the Directorate of PCA DGT, Then we can know by the year 2015 there are 58 million more MSME which is taxpayer criteria of GR 46 have not carried out their tax obligations affecting the potential loss of tax revenue from the MSME sector. The potential loss of tax revenue is influenced by the low compliance of taxpayer in fulfilling his tax obligations to calculate, pay and report his tax liabilities. If the taxpayer obeys in conducting a self assessment to calculate his tax liabilities honestly, as well as pay and report the tax correctly then the potential loss of tax revenue can be avoided. The taxpayer compliance in fulfilling his tax obligations can be studied through the Slipperry Slope Framework theory (Kirchler, Hoelzl, & Wahl, 2008). The compliance with taxation obligations in the theory is divided into two, namely the compliance arising from the existence of elements of coercion (Enforced Tax Compliance) and the compliance arising from self awareness of taxpayer (Voluntary Tax Compliance). The Enforced Tax Compliance arises because of coercion by the authorities as the holder of authority power. The more frequent checks are performed, the more often the billing is made, the more often the prosecution is made, the taxpayer becomes more obedient. If they do not obey, they will be punished. The greater the power of the tax authorities and the more often they use that power, the level of taxpayer compliance will also rise. While the Voluntary Tax Compliance arises because of taxpayer’s trust to the government, so that people will fulfill their tax obligations voluntarily without any coercion. As Eberl (2003) argues that beliefs are described as the special qualities of a relationship, that is, partners in interacting and sharing some positive aspects as well as the motivation to maintain the relationships (Kirchler, Hoelzl, & Wahl, 2008). The decrease of taxpayer's trust on GR 46 leads to the decrease of voluntary tax compliance and if it is not matched by a high enforced tax compliance then the taxpayer will tend to avoid to fulfill his tax obligation in order to increase profit, so that there is a potential loss of tax revenue. In an effort to increase the voluntary tax compliance of taxpayer criteria of GR 46, the DGT has conducted a counseling since the beginning of GR 46 implementation in July 2013 through Letter of Director of Counseling, Services and Public Relations (CSPR) Number S-1046/PJ.09/2013 dated July 12, 2013 regarding Socialization of Government Regulation No. 46 of 2013 followed by piloting the Bussines Development Services (BDS) program at the eight DGT Offices in 2015. The BDS program is a training and coaching activity for MSME by providing materials that contain ways to encourage the MSME business development and the tax-related material to improve the tax compliance. In October 2016, as a follow-up to the trial of BDS program implementation and in the implementation of Initiative 2 Institutional Transformation Program that is Reaching Informal Economy through End to End Approach and improving the MSME taxpayer compliance, Business Development Services (BDS) program implemented nationally, which submitted through Letter of Director General of Tax No. S-284/PJ.13/2016 Date 31 October 2016 concerning Implementation of MSME Taxpayer Development through Business Development Services (BDS) Program. In its implementation, based on data on the growth of the number of taxpayers who become obedient to implement the taxation obligations under GR 46, coaching through the BDS program implemented by the DGT shows an increase in the number of taxpayer of GR 46. However, these results are not optimal when compared with the number of MSMEs recorded by the Ministry of Cooperatives and SMEs. The BDS program implemented by the DGT is in the process of making taxpayer pays attention to the BDS program and is interested to follow but has not yet touched the taxpayer’s trust aspect of the DGT so that the taxpayer intends to know his tax obligations and lead to action, to pay the taxes. The author will perform the factor analysis that affects the low voluntary tax compliance of taxpayer critera of GR 46 which impact on the potential loss of tax revenue through data and interviews from some related institutions, the MSME taxpayer and the tax observers. The author will also try to provide solution recommendation in order to increase the voluntary tax compliance of MSME taxpayer through optimizing the relevant BDS program to increase the voluntary tax compliance so that the potential of tax revenue from MSME sector can be collected or can be realized maximally. Based on those reasons, this study asks the following questions: What factors are causing the voluntary tax compliance on the application of Government Regulation No. 46 of 2013? How is the relevant effort to improve the voluntary tax compliance so that the application of Government Regulation Number 46 Year 2013 can be optimal? Theoretical Review Prof. Dr. P.J.A. Adriani as cited by Tobias (1985) defines the tax as contributions to the state (enforceable) that are owed according to the rules, with no direct achievement, and are used to finance the general expenditures relating to the task of the state to organize the government. Tax is a transfer of wealth from the people to the state to finance the state's routine expenditures and its surplus will be used for public saving which is the main source of public relations investment, in this definition, the emphasis lies in the budgetair function of the tax. In the administration of tax administration, there are some basics for the implementation of good tax administration covers (Mansury, 2002): 1. The clarity and simplicity of the provisions of the law that provide clarity for the taxpayer and facilitate the administration. 2. The simplicity will reduce the tax smuggling. The simplicity is meant both in the simplicity to be exercised by the tax authorities, as well as the simplicity of juridical formulation which gives ease to be understood and obeyed by the taxpayer in fulfilling his tax obligations. The tax rate consists of several types, according to Soemitro (1986) there are four types of tariffs, the first is the fixed tariffs that are fixed or unchanged, even though the amounts used as the basis for calculation change. So, it does not depend on the value of the object being taxed. Second, the proportional tariffs in the form of an unchanged fixed percentage, but if the amount on which the calculation is based changes, then the amount of money to be paid changes as well. The third, the progressive tariffs that the percentage of collection will increase if the amount used as the basis for calculation is greater. The fourth, the degressive tariffs which of its percentage decreases further if the amount used as the basis for calculation is greater. In addition to the four tariffs, there is another tariff that is the final rate. The income tax with the final rate is charged against all income earned in one year based on the tax rate. Slippery Slope Framework The taxpayer's compliance with the taxation obligations can be assessed through the Slipperry Slope Framework theory (Kirchler, Hoelzl, & Wahl, 2008). The compliance with taxation obligations in this theory is divided into two, namely the compliance due to enforced tax compliance and the compliance due to self-awareness of the taxpayer himself (Voluntary Tax Compliance). The Enforced Tax Compliance arises because of the coercion by the authorities as the authority of the holder of power, the more frequent the examination is done, the more billing will be done, the more often the prosecution is done, the taxpayer will be more obedient. If the taxpayer desperate to disobey, then they will be punished. The more power of the tax officer has and the more power it uses, the compliance level of the taxpayer will increase. While the Voluntary Tax Compliance arises because of taxpayer’s trust to the government, so that people will fulfill their tax obligations voluntarily without any coercion. The trust is described as the special quality of a relationship, that is, partners in interacting and sharing the positive aspects as well as the motivation to maintain relationships (Kirchler, Hoelzl, & Wahl, 2008). One dimension of trust in the slippery slope framework is trushworthiness and fairness. The trushworthiness is a consideration of future profits when the taxpayer will abide by the rules of taxation, in this case, the taxpayer who suffers losses/possible losses will have a low trushworhiness. The fairness is a condition in which the taxpayer will become obedient if the government applies fairly (Tan and Liu, 2016). Business Development Services The BDS is defined as some non-financial services provided to MSME sector with support by donors at the various stages of development including in the startup phase (ILO, 2007). These services may include, for example training, counseling and advice, information provision, technology development and transfer and business relationships. The BDS is intended to help MSME overcomes the internal and external constraints in their development and thus improves their performance. In the developing countries, the Micro and Small Medium Enterprises (MSME) has a significant portion of the total workforce, so that the support for the development of formal and informal MSME businesses can provide some higher levels of profits, wages and employment and can contribute to the transition out of entrepreneurs and workers from poverty (Sievers, Vandenberg, 2007). Furthermore, according to Sievers and Vendenberg, one way of strengthening MSME is by improving their access to the key support services for companies that can be divided into two basic categories: (1) the financial services, especially microcredit and (2) the business or the \|Business Development (BDS) program. The BDS program consists of various nonfinancial services that enhance the competitiveness of a company through higher productivity, better product design, better service delivery, and/or increased market access. The implementation of BDS can be combined by applying the marketing theory found by E. St. Elmo Lewis in 1898, the Atenttion, Interest, Desire and Action (AIDA). The AIDA model contains a formula consisting of four steps to gain attention, attract interest, create desires, and take action. In the opinion of Kojima (2010) in (Hasan, Nadzim, Shiratuddin, 2015) AIDA is very useful in assessing the impact of advertising by controlling every process of psychological transformation, starting from an individual level to see the impact of advertising up to the purchases made by the individual concerned. The purpose of a marketing activity leads to the willingness of consumers to buy products, take advantage of services, or follow the wishes of marketers. Kotler in Khusnaini (2016) formulated a stage that must be passed before consumers decide to change the behavior. The stages sequentially include: 1. The stage of attention, is the stage where the marketer trying to make consumers aware and know the existence of a marketed product or a campaign policy/program. Some efforts made at this stage may be promotions, advertisements or campaigns in the printed media, online media, radio or television. 2. The interest stage, after the consumer knows the existence of the product, this stage strives for the consumer to feel agree, happy or interested about the product or service offered, as well as the campaign program. Some efforts undertaken include providing further information about the product, conveying the advantages when having the product, conducting an activity/program/ policy submitted. 3. The stage intent (desire), this is the stage of offering or activities aimed at the consumers being very confident and interested in owning, utilizing the product, or doing a program or policy. 4. The stage decides to buy or change behavior (action), the peak is the consumer is willing to perform activities in order to purchase products, utilize services, or comply with a policy. With the adoption of AIDA in the application of BDS, each of the behavioral stages of the BDS object from the awareness of the product, the attachment to the product, the desire to own the product until deciding to take action by purchasing the product can continue to be monitored, so that the BDS implementation can run effectively and the goal of implementation can be achieved. Research Method This research uses the qualitative research method. The qualitative research is an approach to investigate and understand the meaning of social problems of individuals and groups of people (Creswell, 2014). Furthermore, this research using the case study approach. Thomas (2011) states that the case studiy is conducted in depth on a matter (people, groups, institutions or events), studying them in detail, and not aiming to generalize them (Thomas and Taylor, 2015).Data collection techniques in this study is triangulation of data sources that include observation techniques, interviews, and document analysis. The purpose of using these three techniques is to obtain the information that can complement each other in order to get a complete understanding related to the research topic. Interviews in this study were conducted by: 1. The Principal Researcher at the Ministry of Cooperatives and Small and Medium Enterprises; 2. The Head of Sub-Division of General Income Taxpayer of Fiscal Policy Office; 3. The Head of Data Representation Section Display Directorate of Information Technology Taxation, the DGT; 4. The Head of Sub Directorate Policy Impact, the Directorate of Potential, Compliance and Admission, the DGT; 5. The Head of Section for Impact of Macro Policy, the Directorate of PCA DGT; 6. The Trainer of Education and Training Center Tax; 7. The Tax Observer who is the Director of Center of Indonesia Tax Analysis; and 8. The Four MSME business actors. The informant interviews are selected based on the purposive sampling technique with the criteria include directly involved in the research problems, mastering the problem, having information and /or data, and willing to provide a complete and an accurate information. The selection of resource persons also considers the potential for similarities and recurrences of information to be shared by the parties involved as well as time and cost constraints. The type of interview used in this study is the semi-structured interview. The semi-structured interview is used because it gives a more freedom to the resource persons in answering questions and provides an opportunity for the interviewers to explore answers from the resource persons (Edwards and Holland, 2013). This study takes a case study at the Directorate General of Taxation, Ministry of Finance of the Republic of Indonesia as the authority that administers the tax, in this study especially on the application of Government Regulation No. 46 of 2013. The Implementation of Extension on the application of GR 46 is the scope of the task of Directorate Extensification and Assessment together with Directorate of Counseling, Services and Public Relations. While the study on the impact of the implementation of GR 46 on the taxpayer compliance and the potential revenue is the scope of duties of the Directorate of Potential, Compliance and Tax Revenue. Research Finding and Discussion The research analysis begins by analyzing the low compliance of taxpayer criteria of GR 46 Year 2013 which impact on the potential loss of tax revenue. Through the analysis of comparison of MSME data from the Ministry of Cooperatives and SMEs and Data of the taxpayer number and the amount of tax revenue GR 46 from Directorate of Information Technology Taxation (ITT) and Directorate of Potency, Compliance and Admission (PCA) Directorate General of Taxes. The MSME data consists of: 1. Data on the number of MSME nationally, 2. Data on the number of cooperatives nationally, 3. Data on the role of MSME to investment, 4. Role of MSME data to GDP, and 5. Data growth of business units and labor MSME. The entire data are obtained through an official letter of application from Master of Accounting Program, University of Indonesia. The Analysis of the Low Compliance from Taxpayer Criteria of GR 46 Year 2013 Affecting the Potential Loss of Tax Receipts. Based on the comparison of data on the number of taxpayer of GR46 and MSME, the number of MSME units during 2013 to 2015 increased by 2% or more by 2015 where 59 million more units of MSME. Meanwhile, based on data from the Directorate of PCA DGT, since 2013 to 2015 the percentage increase in the number of taxpayer of GR 46 increased significantly every year, but still very far from the number of potential units of MSME. When we compare data from the Ministry of Cooperatives and SMEs and Data from the Directorate of PCA DGT, so we can know by the year 2015 there are 58 million more MSME which is taxpayer criteria of GR 46, but not yet fulfill its taxation obligation. The growth of the number of taxpayer of GR 46 and the total state revenue from GR 46 in the last four years did not reflect the realization of potential compliance and the tax revenues from the MSME sector, as can be seen from the tax revenue deposited to the state treasury amounting to 3.57 Trillion rupiahs more in 2015 as a result of the application of GR 46 only comes from the participation of 780,608 the obedient taxpayer (the taxpayer of GR 46), or only 1.33% of the total taxpayer criteria of GR 46 recorded on the Ministry of Cooperatives and SMEs by 2015 i.e some 58.5 million more. Whereas in 2016, assuming the number of taxpayer criteria of GR 46 in 2016 is at least equal to the number in 2015 (data on the number of MSME 2016 from the Ministry of Cooperatives and SMEs is not yet available), the percentage of taxpayer of GR46 amounts to only 1.78% of the number of taxpayer criteria of GR 46 with the amount of tax revenue GR 46 of 4.3 Trillion Rupiahs. The low percentage of taxpayer of GR 46 indicates that the compliance level of taxpayer criteria of GR 46 on the application of Government Regulation Number 46 of 2013 is very low. The amount of 4.3 trillion rupiahs more in 2016 deposited to the state treasury as a result of the application of GR 46 was obtained from the participation of 1,046,482 the taxpayer of GR 46 (Appendix II), or only 1.78% of the taxpayer criteria of GR 46 assuming the number of MSME in 2016 equals the number of MSME in 2015 amounting to 58 million more. The potential compliance and acceptance of taxpayer criteria of GR 46 should be realized optimally by increasing the number of taxpayer criteria of GR 46 to the taxpayer of GR 46, so it impacts on the amount of tax revenue to be greater. It can support the achievement of tax revenue targets. Based on the above data analysis, it can be concluded that the realization of revenue from the potential state revenues from taxes on the application of GR 46 is still very far from the value that should be, this is what the author intended as the potential loss tax revenue. After analyzing the data, the authors analyzed the low compliance of the taxpayer criteria of GR 46 of 2013 which had an impact on the potential loss of tax revenue, the authors continued the study by analyzing the factors causing the low compliance of MSME taxpayer of GR 46 in 2013 which had an impact on the potential loss of acceptance tax through the use of the Slippery Slope Framework which is reinforced by the interviews to the relevant sources. The Factor Analysis Causes the Low Compliance of MSME Taxpayer of GR 46 Year 2013 which impact on the Potential Loss of Tax Receipts The taxpayer's compliance with the taxation obligations can be assessed through the Slipperry Slope Framework theory (Kirchler, Hoelzl, & Wahl, 2008). The Compliance to the taxation obligations in this theory is divided into two, namely the compliance due to coersion (Enforced Tax Compliance) and the compliance due to self-awareness of the taxpayer himself (Voluntary Tax Compliance). The Enforced Tax Compliance arises because of coercion by the authorities as the authority of the holder of power, the more frequent the examination is done, the more billing will be done, the more often the prosecution is done, the taxpayer will be more obedient. The ease given by the Government to the MSME taxpayer in fulfilling its tax obligations is inseparable from the Government's objective through GR 46 that is to encourage the growth and development of MSME which impacts on increasing the Voluntary Tax Compliance through some policies that favor to MSME to build the taxpayer’s trust to the Government, especially the DGT. The Voluntary Tax Compliance arises because of the taxpayer's trust to the government, so that the people will fulfill their tax obligations voluntarily without any coercion. The trust is described as the special quality of a relationship, that is, the partner in interacting and sharing the positive aspects as well as the motivation to maintain the relationship. The taxpayer's trust to the tax authorities in this case the DGT, is very important in the realization of Voluntary Tax Compliance. With the trust of the community, it will create a good relationship between the taxpayer and the fiskus in the form of partnerships that can share some positive aspects for both the development of business taxpayer and for the improvement of taxpayer compliance. After discussing the Enforced Tax Compliance and the Voluntary Tax Compliance on the implementation of GR 46, the main objective of issuing GR 46 is to achieve the voluntary tax compliance through the granting of incentives in the form of easiness of tax administration and the low tax rate for the taxpayer is not to enforce the law for achieving the enforced tax compliance, this is reflected in the non-regulated sanctions in GR 46. Based on the slippery slope framework, the low level of voluntary tax compliance occurs because the level of the MSME taxpayer’s trust to the DGT as the tax authorities is still low. Some Efforts to Increase the Voluntary Tax Compliance of Taxpayer Criteria of GR 46 In an effort to increase the voluntary tax compliance of taxpayer criteria of GR 46, the DGT has conducted counseling since the beginning of GR 46 implementation in July 2013 through Letter of Director of Counseling, Service and Public Relations (CSPR) S-1046 / PJ.09 / 2013 Date July 12, 2013 regarding Socialization of Government Regulation No. 46 of 2013 addressed to the Heads of Regional Offices, the Head of Tax Service Office and the Head of Service Office, Extension and Taxation Consultation throughout Indonesia. In October 2016, as a follow-up to the trial of BDS program implementation and in the implementation of Initiative 2 Institutional Transformation Program that is Reaching Informal Economy through End to End Approach and improving MSME Taxpayer compliance, Business Development Services (BDS) program implemented nationally, submitted through Letter of Director General of Tax No. S-284/PJ.13/2016 dated 31 October 2016 concerning Implementation of MSME Taxpayer Development through Business Development Services Program (BDS) where the Directorate of Extensification and Assessment as sponsor of Initiative 2 Institutional Transformation Program. In the letter, after conducting BDS program, the Tax Office is obliged to monitor and prepare a monitoring report on the development of MSME taxpayer through BDS program which is reported in stages through the Regional Office of DGT in this Registration, Extensification and Assessment Field which will perform the report recapitulation of each the Tax Office and subsequently reported to the Director of Extensification and Assessment and Director of CSPR. In this Monitoring Report, there is an information on the amount of participants of business development seminars; the Amount of seminar participants who already have the Tax ID Number; the Amount of seminar participants who have not yet been the Tax ID Number; the Follow-up extensification through the Tax ID Number grant/registration; the Follow-up intensification by listening the number of seminar participants who make regular payments, as well as the Follow-up the implementation of tax class. In its implementation, based on data on the growth of the number of taxpayers who became obedient to the implement taxation obligations under GR 46, coaching through the BDS program implemented by the DGT showed an increase in the number of taxpayer of GR 46, but the results were not optimal when compared with the number of MSME recorded by the Ministry of Cooperatives and SMEs. According to the author analysis, the BDS program conducted by the DJP is still not optimal in touching the heart and growing taxpayer’s trust because the BDS pattern is still limited in the scope of the formalities of training implementation of MSME by providing the materials contain the ways to encourage the development of business MSME and the tax-related material to improve the tax compliance. This evident comes from the follow-up monitoring of BDS implementation that has been described previously, which is only limited to providing reports on the number of participants of the seminar that has been or has not been the Tax ID Number, the follow-up extensification through the Tax ID Number grant/registration, the follow-up of intensification through the data collection of the number of seminar participants to make a regular payments and the follow-up of the implementation of the tax class, so that the relationship between taxpayer and the DGT is limited to the data collection, not yet covering the coaching between MSME and the DGT that are expected to cause taxpayer’s trust to the DGT. In order to achieve the purpose of BDS implementation by the DGT, it is necessary to optimize the implementation of BDS, so that taxpayer’s trust to the DGT as the tax authority by implementing the continuous and sustained assistance pattern, then the Voluntary Tax Compliance can be realized through the willingness of taxpayer to pay the taxes regularly. Optimization of Implementation GR 46 Year 2013 through AIDA Social Mmarketing Concept in the BDS Program As an effort to encourage the growth of MSME which has been successfully implemented by some countries especially by donors (creditors), BDS provides some benefits not only for MSME in increasing the knowledge and skills, so as to increase the business profit. BDS also provides some benefits for the credit institutions (donors) because the credit repayment ability of the debtor is increasing. It avoids a bad debts and especially to provide some benefits for the government as BDS providers because MSME is growing (Sievers & Vandenberg, 2007). Based on the International Labor Organization (ILO) study, BDS is effective in promoting the development of business climate of Small and Medium Enterprises (ILO, 1997). The successful implementation of BDS in MSME also plays a role in increasing tax revenue of a country. By opening access to BDS, it is widely known and available to all MSME and identifying the specific needs of MSME to address the constraints of each MSME is necessary to increase MSME activities as well as the role of MSME in the international trade and impact on the increasing tax revenues, so that the government can improve the infrastructure and provide support for the technological development (Baily, 2007). Through the Business Development Services (BDS) approach, it is expected that there will be a buy-in between the actors of MSME with the Tax Office, so that the tax awareness of taxpayer can grow together with the growth of MSME business. The point is how to generate the motivation to obey the tax by the way of the DGT becomes the facilitator to fulfill the taxpayer requirement, so it expected to create the Voluntary Tax Compliance. However, the extension efforts that have been carried out by the DGT, especially through BDS are regulated in the Director's Letter of Extensification and Assessment number S-170/PJ.06/2015 dated 24 April 2015 on Testing of MSME Taxpayer Development through the Bussines Development Services (BDS) program and the Letter of the Director of Extensification and Assessment Number S-284/ PJ.13/2016 on 31 October 2016 concerning the Implementation of MSME Taxpayer Development through Business Development Services (BDS) program has not produced some optimal results, this is because the method in the application of BDS is still not touching the aspect of Trust of taxpayer criteria of GR 46. Then, it is not optimal to increase the voluntary tax compliance. In contrast to BDS methods performed by the DJP, BDS recommended by the author is BDS with the adoption of social marketing strategy that has been recognized success since the late 18th century to the present that is Attention, Interest, Desire and Action (AIDA) introduced by E. St. Elmo Lewis in 1898. By doing this strategy, the implementation of BDS can be carried out sustainable and continuously, so that there is a sense of confidence in the taxpayer because of the role of the DGT to develop their business. The implementation of BDS combined with social marketing Atenttion, Interest, Desire and Action (AIDA) is expected to produce the above four processes. The AIDA model contains a formula consisting of four steps to gain attention, attract interest, create desires, and take action. In the opinion of Kojima (2010) in (Hasan, Nadzim, Shiratuddin, 2015) AIDA is very useful in assessing the impact of advertising by controlling every process of psychological transformation starting from an individual level to see the impact of advertising up to the purchases made by the individual concerned. The application of AIDA's social marketing strategy to BDS aimed at changing the taxpayer criteria of GR 46 to be compliant is implemented through four stages of AIDA: 1. In the awareness stage, the target audience that is the MSME taxpayer is expected to know and pay attention to the BDS program established by the the Tax Office. The efforts made to attract the attention of MSME taxpayer is to form community groups via social media and send SMS Blast (Bulk) about BDS programs offered. In this stage, it is endeavored not to discuss taxes in particular but rather prioritize the provision of information about the benefits obtained by the taxpayer when following the DGT’s BDS program. 2. The Interest Stage, the taxpayer is expected to be interested to participate in BDS program conducted by the Tax Office through training, gathering of MSME taxpayer and various other efforts aimed to encourage the progress of business from taxpayer. At this stage, the DGT started to provide information – the light information about GR 46. 3. The Stages of desire, after providing BDS training, the Tax Office: a) establish groups in a social media such as Whats-app group or the like as a means to share tips and tricks related to entrepreneurship between the taxpayer and where the Tax Office becomes the Admin of the group. This media can also be a forum for the fellow of MSME taxpayer to help each other in promoting their products. b) by involving the figures of MSME to become "the tax ambassadors" as an extension of the the Tax Office to extend the its network, then it can reach more MSME taxpayer. c) held a gathering event of MSME or a program of visits to the location of the perpetrators of MSME, this activity is intended to foster the closeness between the taxpayer and the Tax Officers as well as to conduct the evaluating and planning of the next BDS program. At this stage, it is expected that the taxpayer begins to feel that the DGT wants to participate in encouraging the development of taxpayer's business in order to progress and develop, resulting in the taxpayer's trust to the DGT because the DGT cares about their efforts and the proximity of taxpayer and the DGT arises. In this stage, the DJP begins focusing to provide a guidance taxation for the taxpayer to know what obligations that need to be done. 4. The Stage of action, at this stage an effort is made to the target respondents who has supported the BDS of DGT program and has benefited from the BDS program and has trusted the DGT to carry out its tax obligations. The goal at this stage is the respondents to make a real effort (action) toward the voluntary tax compliance, that is by registering to get the Tax ID Number or start doing to record the turnover more regularly and in the end to perform the action to pay the tax based on GR 46. Conclusion 1. Based on the analysis of the comparison of data on the development of MSME and the Large Enterprises from 2010 to 2015 (Appendix I), data of the National Cooperative Summary Year 2017 (Ministry of Cooperatives and SMEs and Central Bureau of Statistics) and data of taxpayers and tax revenues GR 46 of 2013 until the year of 2016 (Appendix II), it is known that the compliance level of taxpayer criteria of GR 46 (MSME with turnover ≤ 4.8 Billion) is still very low, so that the potential of state revenue that should be obtained by the DGT is not fully realized. The low level of taxpayer criteria of GR 46 compliance is reflected in the tax revenues deposited into the state treasury of 3.57 trillion rupiahs in 2015 as a result of the application of GR 46 only from the participation of 780,608 taxpayer obedient (the taxpayer of GR 46), or only 1.33% of the total of taxpayer criteria of GR 46 recorded on the Kemenkop and UKM in 2015 which amounted to 58.5 million more. While in 2016, assuming the number of taxpayer criteria GR 46 in 2016 is at least equal to the number in 2015 (data on the number of MSME 2016 from the Ministry of Cooperatives and SMEs is not yet available), then the percentage of total of taxpayer of GR 46 is only 1.78% of the total taxpayer criteria of GR 46 with the amount of tax revenue GR 46 of 4.3 Trillion rupiahs. The low percentage of the number of taxpayer of GR 46 indicates that the compliance level of the taxpayer criteria of GR 46 on the application of Government Regulation Number 46 of 2013 is very low which impacts on the unrealization of all of the potential tax revenue from taxpayer criteria of GR 46, this is what the author intended as the potential loss tax revenue. The Government efforts to encourage the growth of MSME through the policies that favor to MSME by making it easy for MSME taxpayer in fulfilling its tax obligations through the application of GR 46 which also aims to improve the Voluntary Tax Compliance has not yielded a good results, this is reflected of the taxpayer criteria of GR 46 compliance level is very low. Based on the slippery slope framework, the factor causing the low level of voluntary tax compliance is the level of trust of MSME taxpayer to the DGT as the tax authority is still low. So that, increasing the voluntary tax compliance, the DGT as the tax authority should endeavor to increase the taxpayer's trust. 2. Some Efforts to increase the voluntary tax compliance on the application of GR 46 which has been conducted by the DGT through the extension of taxation, especially through BDS as set forth in Letter of Director of Extensification and Assessment number S-170/PJ.06/2015 dated April 24, 2015 on Testing Guidance MSME Taxpayer through Bussines Development Services (BDS) program and Director of Extensification and Assessment Letter No. S-284/ PJ.13/2016 On 31 October 2016, concerning the Implementation of MSME Taxpayer Development through Business Development Services (BDS) program has not produced the optimal results, this is because the method in the application of BDS is still not touching the trust aspect of taxpayer criteria of GR 46, so it has not optimally increase the voluntary tax compliance. To optimize the increase of voluntary tax compliance, the application of BDS combined with the social marketing strategy that has been recognized since the end of the 18th century to the present time is Attention, Interest, Desire and Action (AIDA) method introduced by E. St. Elmo Lewis in 1898. The application of AIDA's social marketing strategy to BDS aimed at changing the taxpayer criteria of GR 46 to be compliant is implemented through four AIDA stages. Suggestion to the Directorate General of Taxes 1. Enabling to overcome the potential loss of tax revenue on the application of GR 46 of 2013, the Directorate General of Taxation as the tax authority in Indonesia should be able to increase the trust of taxpayer criteria GR 46, so as to create the voluntary tax compliance increase which affects the increase of tax revenue realization on the potential tax revenue on the taxpayer criteria of GR 46. 2. For optimum application of GR 46 of 2013, the efforts of the Directorate General of Taxes in increasing the voluntary tax compliance through the implementation of business development services (BDS) that have been applied need to be updated through the implementation of AIDA social marketing strategy. With AIDA strategy, every stage of behavior from the taxpayer starts from the awareness of BDS program, interest in Implementation of BDS program, the desire to know the tax obligation because it has felt helpful in developing its business, to decide to take action by paying taxes due to the existence trust to the DGT can be continuously monitored, so that BDS implementation can be effective and its implementation goal can be achieved. Limitations of Research The discussion of this research is limited to the application of Government Regulation No. 46 of 2013, not on the application of tax laws in general. Suggestions to Further Researchers In relation to the limitation of the research, the suggestion that researchers can convey to the next researcher is to be able to analyze the compliance of taxation thoroughly in order to provide a general advice for the DGT.

Source text - English HADR and SAR Cooperation in Southeast Asia: on the Right Track? __________________________________________ Euan Graham Rajaratnam School of International Studies, Singapore My presentation focuses on Southeast Asia as an important sub-region within the ‘Indo-Pacific’ macro-region for Humanitarian and Disaster Relief (HADR) and Search and Rescue (SAR) cooperation. This has been pointedly highlighted by the mixed record of responses to Typhoon Haiyan/Yolanda in the Philippines in late 2013, the ongoing search for MH370 still missing since March 2014, as well as the successful multinational operation to find and recover Air Asia flight QZ851. How evolved are regional frameworks for maritime cooperation in these areas; what are the major constraints, and what else does this tell us beyond the direct humanitarian and maritime safety requirements that need to be addressed? While it should be recognized upfront that HADR and SAR cooperation pose discrete sets of operational and political challenges, they have jointly emerged and acquired wider significance as the preferred common denominators for regional defense engagement and capacity building, with a particular onus on Southeast Asia. Though neither area is especially controversial SAR, as a mainly maritime activity, is less problematic for regional cooperation than HADR, which is land-focused and therefore more prone to sensitivities from affected states about foreign, especially military, ‘boots on the ground’. SAR collaboration is not without complications either, as exposed during the initial stages of the multinational search for MH370, as well as limited regional support for the 1979 SAR Convention.1 HADR and SAR cooperation in Southeast Asia is at the same time a window on to the strengths and limitations of maritime cooperation in the wider region, and its evolving strategic dynamics. There is an argument to be made for broadening the analytical frame of reference to include the big players in Northeast Asia, most of which are prone to natural disasters, as well as host to military and civil response capabilities with the potential to engage in extra-territorial HADR/SAR operations. However, natural disasters and humanitarian situations affecting Japan, China, Taiwan and South Korea – though frequent in occurrence and sometimes transnational in their effects – fall usually within the capacity of afflicted states to respond at the national level, and are therefore less relevant from the cooperative aspect between states. Operation Tomodachi is rightly regarded as a successful case study in HADR cooperation within a bilateral alliance context. But Japan’s March 2011 triple disaster was a rare event, with perhaps only limited precedent value. However, a connection can be drawn from Tomodachi to Tokyo’s decision to launch the largest overseas HADR operation involving the Self Defense Forces, in the wake of Typhoon Haiyan, in November 2013 – in support of the initial US-led relief effort. At a wider level, the sheer size and diversity of the Indo-Pacific macro-region works against meaningful generalisation. The need for collaborative search-and-rescue and disaster-relief frameworks across such an expansive, disaster-prone littoral area is one obvious common denominator interest linking Asia’s various littoral sub-regions. Natural catastrophes like the December 2004 Indian Ocean Tsunami and man-made accidents like MH370 are ‘Indo-Pacific’ by virtue of the large number of affected states, requiring multinational responses on a macro scale. More localized severe-weather events affecting coastal and islands states in Asia, and a shared vulnerability to inundation from the sea, have further underscored the transnational nature of the threats faced, and the pressing need to deepen cooperative frameworks and to improve regional disaster resilience. Southeast Asia is arguably the critical ‘hinge’ sub-region of the Indo-Pacific, connecting Asia’s two great oceans, via some of the most important transit waterways in the world – raising the strategic importance of maritime and aero SAR. It hosts several enclosed and semi-enclosed seas including the South China Sea – the Indo-Pacific’s logical centre of gravity. When it comes to major HADR/SAR contingencies most Southeast Asian countries, being smaller or less developed than states in Northeast Asia, have only limited military and civil response capabilities to call upon at the national level. In addition to capability gaps, the region’s porous and predominantly maritime geography means that transnational spillover effects are more common. Lingering political constraints and trust deficits continue to limit the potential for cross-border cooperation, especially where borders or maritime jurisdiction are disputed. Typhoon Haiyan, the most powerful recorded storm ever to make landfall, has refocused attention on the need for improved HADR coordination across Southeast Asia, building on the foundations of cooperation that were laid a decade ago following the Indian Ocean tsunami, but which have since developed unevenly. This gives grounds for cautious optimism that Southeast Asian countries are becoming more seized of the imperative to improve frameworks and to build collective capacity for HADR relief efforts, including through ASEAN. In April 2014, Singapore announced the launch of a Regional Humanitarian Assistance and Disaster Relief Coordination Centre, designed to align military HADR efforts in Southeast Asia. The experience of two major search and locate operations for Malaysian-operated aircraft in 2014 has further pushed multinational cooperation in the air and maritime domains further up the regional policy agenda, although at the international level these two SAR regimes remain mis-aligned. Improving UN Responses to Humanitarian Crises In the aftermath of the Second World War, the creation of the United Nations and documents such as the Universal Declaration of Human Rights, the Genocide Convention, the four Geneva Conventions of 1949, and their Additional Protocols, as well as concepts such as responsibility to protect (R2P), have transformed international law and the basis for how states must conduct international relations. Yet, as David Rieff, who has covered several wars and humanitarian emergencies, remarks in his book A Bed for the Night: Humanitarianism in Crisis, the "murderous twentieth century remained just as murderous". In fact, the twenty-first century remains no stranger to humanitarian emergencies: from man-made and natural disasters to wars and revolutions, millions of lives remain at risk. Today, world politics is testing many of these laws and humanitarian relief work in unforeseen ways. At the same time, the Internet and mobile technologies have provided a means to improve data collection and humanitarian response, which provides the United Nations with an opportunity to play a more dynamic role in how it coordinates and responds to humanitarian emergencies. IMPROVING COORDINATION At present, the world community has limited options for responding to humanitarian crises. General Assembly resolution 46/182 formed guiding principles for the international community's response to humanitarian disasters and was central to the establishment of the Office of the Emergency Relief Coordinator (ERC) and the development of the Inter-Agency Standing Committee (IASC). IASC includes major humanitarian actors from both within and outside the United Nations, and is aimed at facilitating inter-agency analysis and decision making in response to humanitarian emergencies. One way IASC strives to improve coordination is through the humanitarian "cluster" system established in 2005. Clusters are groupings of United Nations agencies, non-governmental organizations, and other international organizations concentrating on a specific sector during a humanitarian crisis. There are 11 clusters: protection, camp coordination and management, water sanitation and hygiene, health, emergency shelter, nutrition, emergency telecommunications, logistics, early recovery, education, and agriculture. Each cluster, led by a designated agency, coordinates with the Office for the Coordination of Humanitarian Affairs (OCHA), the United Nations agency accountable for the overall coordination under ERC. Most data is designed to flow through the clusters that process and analyze it, and is used to periodically brief decision makers. However, as many experts have noted, these humanitarian clusters lack the resources to coordinate with OCHA and they tend to manage information in a way that makes it difficult to share. For instance, clusters often choose systems that lock data in tools and formats that cannot be easily shared. Satchit Balsari, a fellow at the Harvard Humanitarian Initiative, an interfaculty initiative which is dedicated to advancing research, practice, and policy in humanitarian assistance, points out that another concern with this system is that not everyone who is working in the field is clued in to the clusters, such as volunteers or those in remote areas. Balsari, who worked in Haiti following the 2010 earthquake, noted that "they often forget to involve stakeholders". He added that for the first couple of months, Haitians were conspicuously absent from these cluster meetings because locals were not allowed into the United Nations compound where meetings were being held. "So decisions were being taken without those who were most affected", he said. DISASTER RELIEF 2.0 According to the March 2011 report by the United Nations Foundation, OCHA, the Vodafone Foundation, and the Harvard Humanitarian Initiative, the cluster system proved inadequate in Haiti when the volume, tempo, and diversity of the inflowing information increased. The publication Disaster Relief 2.0: The Future of Information Sharing in Humanitarian Emergencies looked at how new technologies were being applied to early warning systems for crises and humanitarian responses and how they could become powerful tools in humanitarian relief work. For instance, the crisis mapping response to Haiti's earthquake in 2010 showed how mobile technologies, geospatial data, and citizen-based reporting could influence humanitarian action and disaster response. Today, several online mapping organizations with a humanitarian focus, such as OpenStreetMap, Crisis Mappers, Sahana, and Ushahidi, are employed during critical emergencies around the world. Following the earthquake and tsunami that hit Japan in 2011, crowdsource mapping came in handy for local relief workers as they set priorities for aid delivery of food, shelter, and sanitation services. According to The New York Times, web-based community mapping was also used in Libya to track where the fighting was taking place and the movement of refugees who were fleeing the conflict. The report further noted that "new voices are opening the possibility of closer interactions with communities affected by disasters". It acknowledged that "new partners are offering faster, more effective means of analyzing an ever-increasing volume and velocity of data", and that the challenge ahead will be "to create an effective interface between these resources, and create an ecosystem where each actor understands its role". In this regard, veteran humanitarian organizations such as the United Nations have a particularly significant role to play. According to Patrick Meier, co-founder of the International Network of Crisis Mappers, it is imperative to consolidate key partnerships between formal humanitarian organizations and informal volunteer networks. He urges participation in joint crisis response simulations to ensure "appropriate and robust but flexible mechanisms in 2012". THE DILEMMA OF INTERVENTION A big challenge for the United Nations and its agencies is that they still have major difficulties in providing relief on neutral or balanced terms. In many cases, the Government or a powerful non-state actor denies them access to vulnerable communities. In 2009, towards the end of the civil war in Sri Lanka, the Government denied United Nations aid agencies and humanitarian workers access to camps for internally displaced persons and to civilians trapped in the ongoing conflict between the military and the terrorist group Liberation Tigers of Tamil Eelam. Also in 2009, al-Shabaab, a terrorist militant group controlling most of southern Somalia, banned several international aid groups from the region, resulting in widespread famine. As noted in the book United Nations and Changing World Politics: "In many ways international humanitarian law seems to have been formulated to deal with a different world -- one populated by governments and regular armies whose interests were often served by respecting the laws of war." Sovereignty is also often a big sticking point. General Assembly resolution 46/182 reiterates that "the sovereignty, territorial integrity, and national unity of states must be fully respected in accordance with the Charter of the United Nations", which makes it difficult to operate in situations where the affected country denies access. To address the challenge of the international community's responsibility to act in the face of grave human rights violations while respecting the sovereignty of states, the International Commission on Intervention and State Sovereignty was established in 2000. The Commission formulated the concept of responsibility to protect (R2P), which states that the international community must protect the population of a state if its own Government fails to do so. It also allows for the use of military force if peaceful measures prove inadequate. Co-chairs of the Commission, Gareth Evans of the International Crisis Group and Algerian diplomat Mohamed Sahnoun, wrote in Foreign Affairs: "If the international community is to respond to this challenge, the whole debate must be turned on its head. The issue must be reframed not as an argument about the 'right to intervene' but about the 'responsibility to protect'." The R2P doctrine was finally incorporated in a United Nations outcome document in 2005, and was hailed by international affairs specialists as a new dawn for peace and security. Since then, the R2P principle has been applied in Kenya, following the post-election violence in 2008, and more notably in Libya in 2011, following former leader Muammar al-Qaddafi's brutal crackdown on its people during the revolt against his regime. While R2P advocates welcomed the NATO-led military intervention, others questioned the hypocrisy of intervening in one country, while the regimes of neighbouring countries used violence and intimidation to suppress mass uprisings, notably in Syria and Bahrain. Moreover, it's far from clear if the humanitarian military intervention in Libya would be able to guarantee a better and peaceful future for its people. Experts like Micah Zenko at the Council on Foreign Relations argue that "mismanagement and overreach" in Libya has made future intervention on the grounds of R2P uncertain. Although NATO claimed to be an impartial actor in the conflict, he says, "Its actions -- allowing the rebel forces to smuggle weapons into the country and fly aircraft in the no-fly zone and coordinating its air strikes with their military operations, for instance -- proved otherwise". AID UNDER THE SECURITY OF THE GUN While coercive military intervention in the future will prove difficult to achieve, a military component of some kind has become increasingly necessary in most humanitarian crises. Adam Levine, Assistant Professor of Emergency Medicine at Brown University who worked on providing emergency aid in Libya says, "You can't have healthcare without security". According to Levine, humanitarian aid in Libya would have been difficult to provide without the security cover provided by the presence of NATO. As the need for a securit y presence for humanitarian relief work grows, the role of United Nat ions peacekeepers expands as they are considered more neutral than the military of any one country. However, peacekeepers hardly enjoy an unblemished reputation: they have been accused of sex crimes such as rape and sexual exploitation in many countries, including Haiti, Liberia, Côte d'Ivoire, Somalia and t he Democratic Republic of the Congo. Therefore, the human rights risks accompanying the behaviour of security forces from any particular country also apply to peacekeepers from many different countries. The United Nations must investigate thoroughly all allegations, prosecute those alleged to have committed crimes, and hold accountable the countries from which those peacekeepers found guilty came. To the extent that humanitarian aid must take place under the security of the gun, the United Nations will also have to consider other issues in order to improve its response. Levine says there needs to be better coordination between security providers and aid workers so that areas can be secured for humanitarian aid delivery. There will have to be better mutual understanding of cultures and systems between humanitarian aid workers and troops, so as to develop mutual respect. To do this, it would be useful to put in place an ongoing programme of strategic and operational discussions at all levels. Except in situations where humanitarian workers have no access to vulnerable areas or populations, the military should not normally engage in providing aid. Provision of aid by the military undermines neutrality, and is hardly the most effective way of providing humanitarian assistance. Some experts have also recommended reducing the number of non-governmental organizations in humanitarian emergencies to only those that abide by a certain set of standards, such as the Red Cross Code of Conduct. Greater emphasis on the same set of standards for all organizations working in emergencies will help in streamlining aid. This process must start now, says Levine, because once a humanitarian emergency occurs "it's almost too late in some ways".	Translation - Indonesian Kerja sama antara SAR dan HADR Asia Tenggara: Sudahkan dalam Jalan Yang Benar? ____________________________________ Euan Graham Rajaratnam dari School of International Studies (Jurusan Kajian Internasional), Singapura. Presentasi saya berfokus pada Asia Tenggara sebagai sub-wilayah yang penting dalam makro wilayah Indo-Pasifik bagi kerjasama Bantuan Kemanusiaan dan Pemulihan Bencana (Humanitarian Assistance and Disaster Relief /HADR) and Pencarian dan Penyelamatan Korban (Search and Rescue/SAR). Hal ini telah ditunjukkan dengan sorotan pada bermacam tanggap darurat pada Kejadian Topan Haiyan/Yolanda di Filipina pada akhir 2013, juga pencarian yang masih dilakukan pada hilangnya pesawat MH370 sejak Maret 2014, dan juga keberhasilan operasi multinasional pencarian dan penemuan atas kecelakaan penerbangan Air Asia QZ851. Bagaimana berkembangan kerangka kerja regional bagi kerjasama maritim di area ini; apakah ada kendala utama, dan apakah ada hal lainnya yang perlu dikaji untuk persyaratan keselamatan bagi kemanusiaan dan maritim yang tepat di masa depan? Sementara itu perlu dikenali terlebih dahulu bahwa kerjasama HADR dan SAR memperlihatkan sejumlah operasi dan tantangan politik, mereka telah bergabung dalam situasi keadaan darurat dan butuh makna yang lebih luas seperti penyebutan yang lebih disukai bagi kerjasama pertahanan regional dan pengembagan kemampuan, dengan sebuah tanggung jawab khusus di Asia Tenggara. Walaupun tidak ada area SAR yang khusus dan kontroversi, sebagaimana kegiatan maritim utama, adalah kurang problematik bagi kerjasama regional daripada HADR, di mana berfokus pada daratan dan karenanya lebih sensitif bagi negara terdampak tentang hadirnya orang asing, khususnya militer. Kolaborasi SAR bukannya tanpa komplikasi, seperti tampak pada pencarian multinasional pesawat MH370, dan juga minimnya bantuan regional bagi Konvensi SAR 1979.1 Kerjasama HADR dan SAR di Asia Tenggara pada saat yang sama adalah sebuah jendela untuk penguatan dan kerjasama maritim terbatas dalam wilayah lebih luas dan perkembangan dinamika strateginya. Ada sebuah argumen yang dibuat untuk memperluas kerangka analisis untuk memasukkan pemain besar di Asia Timur Laut (Northeast Asia), sebagian besar rawan terhadap bencana alam, juga sebagai tuan rumah bagi kemampuan tanggap pihak militer dan masyarakat sipil dengan potensi untuk terlibat pada operasi ekstra-teritorial HADR/SAR. Akan tetapi, bencana alam dan situasi kemanusiaan mempengaruhi Jepang, Cina, Taiwan, dan Korea Selatan – walaupun sering terjadi dan kadang dalam keadaan transnasional- karenanya kurang relevan dari aspek kerjasama antar negara. Operasi Tomodochi dapat dikatakan sebagai kasus studi yang tepat bagi kerjasam HADR dalam konteks aliansi bilateral. Tetapi tiga bencana yang melanda Jepang pada Maret 2011 adalah kejadian yang jarang, di mana hanya mungkin menjadi teladan yang terbatas. Akan tetapi, sebuah hubungan dapat ditarik dari Tomodachi terhadap keputusan Tokyo untuk meluncurkan operasi HADR luar negeri lebih besar yang melibatkan Angkatan Pertahanan Diri, dalam kejadian Topan Haiyan, pada Nopember 2013- untuk mendukung usaha pemulihan yang dipimpin oleh Amerika Serikat. Topan Haiyan juga menjadi sebuah katalis penting yang mempengaruhi kerjasama HADR di Asia Tenggara, menyajikan sebuah panggilan bagi kolektivitas lebih kuat akan kamampuan tanggap darurat atas perkembangan 10 anggota ASEAN sampai sekarang. Pada level lebih luas, bermacam-macam kerja makro-regional Indo-Pasifik berlawanan dengan generalisasi. Kebutuhan kerjasama SAR dan HADR dalam kerangka kerja menyeluruh dalam sebuah area pesisir yang rawan bencana besar adalah sebuah kepentingan umum yang jelas juga menghubungkan sub wilayah pesisir yang bermacam-macam di Asia. Bencana alam seperti pada Desember 2004, yaitu Tsunami di Samudera India dan kecelakaan oleh kesalahan manusia seperti pesawat MH370 adalah ‘kebajikan bagi Indo-Pasifik’ karena banyaknya jumlah negara yang terdampak, di mana memerlukan tanggap darurat multinasional pada skala makro. Banyak bencana dikarenakan cuaca buruk berdampak pada negara kepulauan di Asia yang juga rentan terhadap rob air laut, adalah perlu digarisbawahi sebagai ancaman kejadian alam transnasional, sehingga diperlukan kerangka kerjasama lebih dalam untuk memperbaiki ketahanan terhadap bencana secara regional. Asia Tenggara dapat dikatakan sebuah ‘sendi’ sub regional dari Indo-Pasifik, yang menguhubungkan dua Samudera besar Asia, melalui sejumlah transit jalan laut yang paling penting di dunia- meningkatkan pentingnya strategi maritim dan SAR udara. Asia Tenggara juga memiliki sejumlah lautan tertutup dan semi tertutup termasuk Laut Cina Selatan- yang secara logis menjadi pusat dari Indo Pasifik. Ketika kejadian HADR/SAR utama di banyak negara Asia Tenggara, wilayah negara yang perkembangannya kurang dari negara-negara di Asia Timur Laut, hanya punya kemampuan tanggap darurat terbatas pada pihak militer dan masyarakat sipil pada tingkat nasional. Sebagai tambahan dari kesenjangan kemampuan, wilayah yang didominasi oleh lautan berarti bahwa dampak berlebihan adalah menjadi hal yang umum. Kendala batin politik dan defisit kepercayaan berlanjut pada minimnya potensi kerjasama lintas perbatasan, khususnya dimana batas negara atau wilayah hukum maritim yang dipertentangkan. Topan Haiyan, badai paling dahsyat yang pernah tercatat, telah memfokuskan perhatian pada kebutuhan perbaikan koordinasi HADR antara negara Asia Tenggara, yang dasar kerjasamanya dibangun sekitar satu dasawarsa lalu ketika bencana Tsunami di Samudera India, tetapi berkembang tidak merata. Hal ini memberikan dasar bagi optimisme bahwa negara-negara Asia Tenggara adalah lebih wajib memperbaiki kerangka kerja dan membangun kemampuan kolektif bagi usaha pemulihan HADR, termasuk melalui ASEAN. Pada April 2014, Singapura mengumumkan peluncuran sebuah Pusat Koordinasi Pemulihan Regional HADR, yang dirancang untuk menyelaraskan militer pada usaha HADR di Asia Tenggara. Pengalaman pada dua kejadian utama dan operasi pada kecelakaan pesawat Malaysia 2014 telah mendorong kerjasama multinasional di kawasan udara dan laut yang juga menjadi agenda kebijakan regional, walaupun pada tingkat internasional dua SAR ini masih kurang selaras. Perbaikan Tanggap Darurat PBB pada Krisis Kemanusiaan Setelah Perang Dunia Kedua, pembentukan PBB dan dokumen seperti Deklarasi Umum Hak Asasi Manusia, Konvensi Genosida, empat Konvensi Jenewa 1949, dan Protokol Tambahan, dan juga konsep tanggung jawab terhadap perlindungan (responsibility to protect/R2P), telah menjadi hukum internasional dan dasar bagi negara untuk menjalin hubungan internasional. David Rieff yang merangkum sejumlah perang dan keadaan darurat kemanusiaan dalam bukunya A Bed for the Night: Humanitarianism in Crisis sebagai sebuah “pembunuhan abad dua puluh tetaplah menjadi pembunuhan”. Faktanya, pada abad dua puluh satu tetaplah tidak asing bagi keadaan tanggap darurat kemanusian: dari musibah karena ulah manusia dan alam sampai pada perang dan revolusi, jutaan jiwa masih berisiko. Kini, politik dunia sedang menguji hukum ini dan kerja pemulihan kemanusiaan dalam cara yang tak terprediksikan. Pada saat yang sama, teknologi internet dan nir kabel memberikan sebuah sarana untuk memperbaiki pengumpulan data dan tanggap darurat kemanusiaan, di mana memberikan PBB sebuah kesempatan untuk memainkan peran lebih dinamis dalam rangka koordinasi dan tanggap akan keadaan darurat kemanusiaan. PERBAIKAN KOORDINASI Pada saat ini, komunitas dunia mempunyai pilihan terbatas untuk merespon krisis kemanusiaan. Resolusi Majelis Umum PBB 46/182 membuat prinsip-prinsip pedoman bagi tanggap darurat komunitas internasional untuk bencana kemanusiaan dan memusatkan pada pembentukan kantor Koordinator Pemulihan Darurat (Emergency Relief Coordinator/ERC) dan pengembangan Komite Tetap Antar Agensi (Inter-Agency Standing Committee/IASC). IASC memasukkan pelaku bidang kemanusiaan utama dari dalam dan luar PBB yang bertujuan memfasilitasi analisis antar agensi dan pengambilan keputusan dalam merespon keadaan darurat kamanusiaan. Salah satu cara IASC memperbaiki koordinasi adalah lewat sistem “gugus” kemanusiaan yang dibentuk pada tahun 2005. Gugus-gugus itu mengelompokkan agensi PBB, LSM, dan organisasi internasional lainnya yang memusatkan pada sektor khusus selama krisis kemanusiaan. Ada 11 gugus: perlindungan, koordinasi dan manajemen daerah pengungsi, sanitasi dan kebersihan air, kesehatan, tenda darurat, nutrisi, telekomunikasi darurat, logistik, pertolongan pertama, pendidikan dan pertanian. Tiap gugus dipimpin oleh sebuah agensi yang dibentuk, berkoordinasi dengan Kantor bagi Koordinasi Urusan Kemanusiaan (Office for the Coordination of Humanitarian Affairs/OCHA), agensi PBB bertanggung jawab pada koordinasi menyeluruh di bawah ERC. Sejumlah besar data dirancang untuk mengikuti gugus ini kemudian proses dan analisisnya yang digunakan secara rutin untuk pembuat kebijakan secara cepat. Namun, banyak ahli memberikan catatan, bahwa gugus kemanusiaan ini kekurangan sumber daya untuk berkoordinasi dengan OCHA dan mereka cenderung mengolah informasi dengan cara yang sulit untuk dibagikan bersama. Contohnya, gugus itu sering memilih sistem yang mengunci data dalam sebuah alat dan format yang tidak mudah dibagikan. Satchit Balsari, seorang ilmuan di Harvard Humanitarian Initiative, sebuah inisiatif antar fakultas yang ditujukan untuk riset, praktik dan kebijakan tingkat lanjut dalam bantuan kemanusiaan, menunjukkan kecenderungan lain dengan sistem ini bahwa tidak semua orang yang bekerja pada bidang ini memberikan petunjuk pada gugus tersebut, seperti relawan atau mereka di area terpencil. Balsari, yang bekerja di Haiti pada gempa bumi 2010, memberi catatan bahwa “mereka sering lupa melibatkan para pemangku kebijakan”. Dia menambahkan bahwa dalam dua bulan, orang Haiti tidak hadir secara mencolok dari pertemuan gugus ini karena orang setempat tidak diperbolehkan berkumpul di kamp PBB di mana pertemuan itu dilaksanakan. “Jadi keputusan tidak melibatkan mereka yang paling terdampak”, katanya. PEMULIHAN BENCANA 2.0 (DISASTER RELIEF 2.0) Berdasarkan laporan Maret 2011 oleh Yayasan PBB, OCHA, Yayasan Vodafone, dan Harvard Humanitarian Initiative, sistem gugus membuktikan ketidakmampuan di Hati ketika volume, waktu dan kemajemukan arus informasi meningkat. Publikasi Pemulihan Bencana 2.0: Gabungan Informasi Masa Depan dalam Keadaan Darurat Kemanusiaan menunjukkan bagaimana teknologi digunakan dalam sistem peringatan dini untuk tanggap darurat krisis dan kemanusiaan dan cara bagaimana mereka menjadi alat yang ampuh dalam kerja pemulihan kemanusiaan. Contohnya, krisis tanggap darurat dalam pemetaan gempa bumi Haiti 2010 menunjukkan bagaimana teknologi nir kable, data geospasial, dan laporan berbasis masyarakat dalam mempengaruhi tindakan kemanusiaan dan respon terhadap bencana. Saat ini, sejumlah organisasi pemetaan melalui internet yang fokus pada kemanusiaan, seperti OpenStreetMap,Crisis Mappers, Sahana, and Ushahidi, dikaryakan selama keadaan darurat di seluruh dunia. Gempa bumi dan tsunami yang menghantam Jepang pada 2011, banyak sumber pemetaan berada di tangan para pekerja lokal untuk pemulihan ketika mereka merancang prioritas bagi pemberian bantuan makanan, tenda, dan layanan sanitasi. Menurut The New York Times, komunitas pemetaaan berbasis jaringan internet juga dilibatkan di Libya untuk melacak lokasi terjadi perang dan pergerakan pengungi yang menghindar dari konflik. Laporang lanjutan mencatat bahwa “suara baru yang membuka kemungkinan interaksi lebih dekat dengan komunitas terdampak bencana”. Hal ini adalah pengakuan bahwa “mitra baru memberikan alat yang efektif dan lebih cepat untuk analisis peningkatan volume dan kecepatan data”, dan tantangan ke depan adalah akan menjadi “pembuatan hubungan yang efektif antara sumber daya ini dan mengkreasi sebuah ekosistem di mana tiap pelaku paham atas perannya”. Dalam hal ini, organisasi kemanusiaan yang berpengalaman seperti PBB punya peran penting yang khusus untuk dimainkan. Menurut Patrick Meier, salah satu pendiri International Network of Crisis Mappers, adalah suatu kewajiban untuk mengkonsolidasikan kemitraan kunci antara organisasi kemanusiaan formal dan jaringan relawan informal. Dia menekankan pentingnya partisipasi dalam tanggap darurat terhadap krisis secara bersama dan simultan untuk memastikan “ ketepatan dan kekuatan dalam mekanisme yang fleksibel pada 2012”. DILEMA INTERVENSI Sebuah tantangan besar bagi PBB dan agensinya bahwa mereka masih punya kendala utama dalam memberikan pemulihan dalam batasan yang netral dan berimbang. Dalam banyak kasus, Pemerintah atau pelaku non negara yang kuat tidak memperbolehkan mereka untuk masuk pada komunitas rentan. Di tahun 2009, pada akhir perang sipil di Sri Lanka, Pemerintah mencegah agensi bantuan PBB dan pekerja kemanusiaan untuk masuk ke kamp guna penggantian personil internal dan bagi warga sipil yang terjebak dalam konflik yang berlangsung antara militer dan kelompok teroris Kemerdekaan Macan Tamil Eelam. Juga di tahun 2009, al-Shabaab, sebuah kelompok teroris militan yang menguasi sebagain besar Somalia selatan, melarang sejumlah kelompok bantuan internasional masuk ke wilayah tersebut, yang mengakibatkan kelaparan semakin meluas. Seperti tercatat dalam buku United Nations and Changing World Politics: "Dalam banyak cara, hukum kemanusiaan internasional tampaknya diformulasikan untuk sejalan dengan dunia yang berbeda – satu populasi oleh pemerintah dan tentara regular yang punya kepentingan di mana mereka bekerja berdasarkan hukum perang.” Kedaulatan juga sering menjadi titik penghambat besar. Resolusi Majelis Umum PBB 46/182 mengulangi bahwa “kedaulatan, integritas teritorial dan kesatuan nasional negara harus selaras dengan Piagam PBB”, yang mana mendapat kesulitan untuk diterapkan pada situasi di mana negara terdampak tidak memberikan akses. Untuk memperlihatkan tantangan terhadap tanggung jawab komunitas internasional untuk beraksi pada pelanggaran hak asasi manusia yang juga menghormati kedaulatan sebuah negara, Komisi Internasional atas Intervensi dan Kedaulatan Negara (International Commission on Intervention and State Sovereignty) dibentuk pada tahun 2000. Komisi ini memformulasikan konsep tanggung jawab untuk melindungi (responsibility to protect /R2P), yang mana negara dalam komunitas internasional harus melindungi populasi sebuah negara jika pemerintahnya sendiri gagal melakukannya. Komisi ini juga memperbolehkan penggunaan kekuatan militer jika perdamaian tidak tercapai. Wakil Komisi ini, dari Gareth Evans of the International Crisis Group and diplomat Aljazair Mohamed Sahnoun, menulis dalam Urusan Luar Negeri:”Jika komunitas internasional harus menghadapi tantangan ini, semua perdebatan harus kembali pada kepalanya. Isu ini harus dimaknai bukan sebagai sebuah argumen tentang ‘hak untuk intervensi’ tapi tentang ‘tanggung jawab untuk melindungi’.” Doktrin R2P secara final terangkai dengan dokumen PBB di tahun 2005, dan dipuji oleh ahli urusan internasional sebagai sebuah fajar baru bagi perdamaian dan keamanan. Sejak itu, prinsip R2P diaplikasi di Kenya, karena adanya kekerasan pasca pemilu presiden di tahun 2008, dan lebih lagi di Libya di tahun 2011, setelah mantan pemimpin Muammar al-Qaddafi melakukan tindakan brutal atas rakyatnya dalam sebuah revolusi yang menentang rejimnya. Sementara R2P memberikan sinyal diberlakukannya intervensi militer yang dipimpin oleh NATO, para ahli lainnya mempertanyakan kemunafikan intervensi atas sebuah negara, sementara rejim negara-negara tetangga menggunakan kekerasan dan intimidasi untuk menekan pemberontakan masa, seperti di Siria dan Bahrain. Lebih lanjut, adalah tidak jelas jika intervensi militer pada kasus kemanusiaan di Libya akan menjamin masa depan kedamaian yang lebih baik bagi rakyatnya. Para pakar seperti Micah Zenko pada Dewan Hubungan Luar Negeri berargumen bahwa “salah manajemen dan aksi yang terlalu” di Libya membuat intervensi masa depan atas penggunan R2P menjadi tidak pasti. Walaupun NATO mengklaim menjadi aktor tak memihak pada konflik itu, dia berkata,”Tindakan ini – dengan memperbolehkan kekuatan pemberontak untuk menyelundupkan senjata ke dalam negara dan menerbangkan pesawat di zona larangan terbang dan mengkoordinasikan serangan udara dengan operasi militer, sebagai contohnya – membuktikan sebaliknya”. BANTUAN DI BAWAH PERLINDUNGAN SENJATA Sementara intervensi kekuatan militer di masa depan akan terbukti sulit dicapai, kebutuhan kekuatan militer telah meningkat pada kebanyakan krisis kemanusiaan. Adam Levine, seorang Asisten Profesor Obatan-obatan Darurat pada Universitas Brown yang bekerja di bagian persediaan darurat di Libya mengatakan,”Anda tidak dapat melakukan tindakan kesehatan tanpa adanya keamanan”. Menurut Levine, bantuan kemanusiaan di Libya akan sulit diberikan tanpa keamanan yang dikomandoi NATO. Ketika kebutuhan akan adanya keamanan pada kerja pemulihan kemanusiaan meningkat, peran penjaga perdamaian PBB dikenal lebih netral daripada pihak militer dari setiap negara. Akan tetapi, penjaga perdamaian sulit untuk mendapatkan reputasi yang baik: mereka melakukan tindakan kejahatan seksual seperti perkosaan dan eksploitasi seksual di banyak negara, termasuk Haiti, Liberia, Pantai Gading, Somalia, dan Republik Rakyat Congo. Kecuali pada situasi di mana pekerja kemanusiaan tidak punya akses terhadap area rentan atau populasi, pihak militer dapat melakukan tindakan-memaksa dalam memberikan bantuan. Persyaratan bantuan oleh militer yang merusak netralitas, dan sulitnya cara yang paling efektif dalam penyediaan bantuan kemanusiaan. Sejumlah ahli juga merekomendasikan pengurangan jumlah LSM dalam keadaan darurat kemanusiaan hanya bagi yang memenuhi standar tertentu, seperti Red Cross Code of Conduct.
